This was a VERY major defeat for Krinsky and Shemtov who were seeking control of the 770 Shull and to eject the Gaboim of the Rebbe's Shull. The Judge also said that the Building Structure belonged to Merkos and Agudas, but that was never in dispute by the Gaboim, since the gaboim never had any interest in the structure except for the Shull where they still continue to maintain Control.

While Krinsky could have rights to the general outside structure to affix his Zaya Plaque on the structure of the building, he will no doubt also be barred from doing so at the entrance to the Shull, when the case will undoubtedly be appealed to a higher court.

DaasHakohol legal analysts pointed out that:

Judge Harkavy decision, totally failed to address the precise location of the Plaque.

Merkos and Aguch ownership of the structure, could give them the right to affix a plaque of their choice at the ENTRANCE to 784-788 (On Top of the Porch - Entrance to Krinsky's Offices) - but NOT at the Entrance to Shull where Judge Harkavy Barred Merkos and Aguch access!

Netzigim Report - Rubashkin Failed at Impeachment Attempt against Nash

Yisroel Best Headed to the Hospital - Rubashkin Heading Back to Fort Dix Prison - by Phone RECORDED Psak Din of the Mara Deasra Rabbi Osdoba Shelita

Moshe Rubashkin illegally called a N'tzigim meeting today in his house to impeach Leibish Nash, for following the clear din in Shulchan Aruch, that when someone refuses to come to a Din Torah, he can then be sued in secular court.

At the meeting, N'tzigim Chairman Yisroel Best attempted to take a roll call.

Rubashkin did not allow Best to speak, insisting that he was no longer the Chairman, since Rubashkin has already replaced him with his crony, Benny Raskin (who is not really a N'tzig anyway, as his Shul has removed him for his complicity in Rubashkin's crimes).

When Best patiently continued calling the roll from a list he held in his hands. Suddenly it dawned on Rubashkin that he did not have the votes to impeach Nash, whereupon he flew into a rage and grabbed the list out of Best's hands and crumpled it up.

When Best attempted to reach for the list, Rubashkin violently assaulted him and repeatedly punched him in the head until he was restrained by several people.

Best suffered head trauma, a broken tooth, a broken or dislocated jaw, broken glasses, a big gash on his forehead, and several severe bruises. He is currently in the hospital for evaluation and treatment. (Please say a kapitel Tehillim for his refua shleima.)

Needless to say, this felony assault can result in a lengthy jail sentence for Mr. Rubashkin. Therefore, Best hesitated to press charges and have Rubashkin arrested.

While Best was being taken to the hospital, he requested that a p'sak be obtained from a Rov as to whether he should file charges against Rubashkin.

The Moro D'asro, Rabbi Schwei was consulted, but he refused to pasken, since Rubashkin has withheld his check for several months, causing him to be biased against Rubashkin. Rabbis Mangel and Bogomilsky were also consulted but they were hesitant to pasken on such a grave matter.

Finally, the Moro D'asra, Rabbi Osdoba was called. Rabbi Osdoba was told the entire story without identifying the parties involved and was asked what should be done.

In response, he paskened that charges must be filed immediately and that only afterwards should the perpetrator be called to a Din Torah and if he made amends, perhaps the Beis Din would ask the complainant to drop charges.

Rabbi Osdoba was then told that the perpetrator is on Parole and would probably be imprisoned for many years as a result of the charges. He responded, "So what? That gives him a right to hit people? That's his problem!"

DaasHakohol.com has learned that the conversation with Rabbi Osdoba was recorded on the caller's Treo cellphone via a recording program called CallRec (see http://blog.treonauts.com/2005/11/treo_call_sound.html).

It is clear as day that Rubashkin is completely out of control. In the court case, new information has come out that indicates that Rubashkin's criminal actions and g'neivos far exceed anything the plaintiffs ever imagined. His violent behavior shows that he will stop at nothing to hold onto power.

If he is not stopped, Rubashkin is liable to literally KILL someone based on Rabbi Osdoba and Segal's p'sak din that they're mosrim and that they have a "DIN RODEF"

Following Rabbi Osdoba's clear p'sak, Best will file charges upon his release from the hospital.

DaasHakohol.com hopes Rubashkin will see the writing on the wall and resign from the Va'ad Hakohol in order to spare himself a lengthy prison sentence.

If he does not, he will have only himself to blame.

The word is out that the Anash who have taken Rubashkin to court, Nash and the Executive Board members of the Netzigim, have requested a postponement in Court. The reason is that they have switched lawyers and need more time for the lawyer to familiarize himself with the case.

The Anash have switched lawyers reportedly because they feel their new lawyer has more experience with Jewish communal cases. He is based in Williamsburg and is familiar with relevant halacha and Jewish attitudes.

The exact extent of the postponement will not be known until the Court session.

Special Fund Established to Compensate for Rubashkin's Refusal to Pay the Salary of the Mara Deasra, Harav Schwei Shelita

Unfortunately, for the past few months the Va'ad Hakahal has not paid the salary of Harav Schwei, who works tirelessly on behalf of the community, as we are all aware. Therefore, a temporary fund has been established for this purpose of paying Rabbi Schwei's salary. This fund will be administered by the undersigned, and will cover Rabbi Schwei's salary and his expenses related to the Beis Din.

Earlier this week, Segal, interviewd by the Anti Meshichist, Machlokes, Loshon Hora web site, known as Col (which always battles and belittles the Badataz and all Meshichisten,) Segal chose to Attack a honorary member of the Vaad Hakohol, Reb Leibish Nash, referring to him as a “RODEF” which essentially means that Segal was implying and insinuating, legitimizing, Attempted Murder, against Nash, Chas V’Sholom, as Segal specifically hinted this in his interview.

Crown Heights residents were shocked and outraged, how any person who is attempting to become a Chaver Habadatz, can dare to stoop so low, for such an interview, while using such expressions unfit for any self respecting person, never mind someone interested, to eventually be a Rov by Yidden, anytime in the future.

The Real Story:

We are not speaking about any one individual but rather a very large group of Anash, residents of the neighborhood, who all stand united, in the court case, whose intent it is, to preserve the C.H. neighborhood and its funds from the dictatorship of one individual who single handedly uses the funds as he wishes without any supervision or accountability. We are dealing with a Fisher type of Dictatorship where he too used the community funds for his private interests, until a group of Anash (including Brook) succeeded in removing Fisher, then the “Rosh Hakohol”, from his dictatorship.

The court complaint, by a large group of Anash, was originally filed by two Vaad Hakohol members, Leibish Nash and Chanina Sperlin, However, since Boimelgreen threatened Sperlin that he will invest 1 Million Dollars for private investigators, in order to try and dig up some possible dirt against Sperlin and to try and use whatever he may find, as a Baseless Mesira (As the Misnagdim did against Chassidim) and then, Rubashkin too, joined in, to threaten Sperlin’s Entire Family – Sperlin then reluctantly had to remove his name from the legitimate complaint against Rubashkin, out of fear that the two of them (Rubashkin, Boimelgreen) who have no integrity will actually do the unthinkable.

It’s noteworthy that the plaintiffs had first called Rubashkin to a Din Torah, by a Beis Din comprised of the Mara Deasra Harav Aaron Yaakov Schwei and with him the Rabbonim the Geonim, who were always sitting at Din Torah’s in the Badatz, for many years, Rabbi Nissan Mangel and Rabbi Shumel Pesach Bogomilsky – who all together had called Rubashkin to “a Din Torah by Zabla”, but Rubashkin refused any Din Torah by Zabla.

Not only did Rubashkin not agree to come to a Din Torah of Zabla, but in order for Rubashkin to establish a Monopoly in the Badatz, Rubashkin attempted Elections which he conducted against the will of the majority of the C.H. Community, using undemocratic methods, including forging the Election Results.

All this, was done, in order that Rubashkin, should be able to install, his personal candidate, Segal, with 2 more of Rubashkin’s followers, into the Badatz. Rubashkin was hoping, to then have a fake “majority”, to appose Rabbi Schwei, so that Rubashkin will be able to evade accountability and real Justice in any Real Din Torah.

However by Rubashkin doing all this, he created an unprecedented, huge split and Machlokes in the community, including a split in the Vaad Hakohol, Netzigim and the Shulls they represent.

Rubashkin and his people, could care less about all of the incredible Destruction and Machlokes they have caused. To them, their Corrupt Machlokes is a Means to an End, for them to be able to achieve their ultimate corrupt goals.

In order to enforce a Din Torah or when a defendant refuses to appear to a Din Torah, the Rabbonim may permit the Plaintiff to proceed with his complaint in court. Since it involves huge sums of community funds and corrupt management of communal affairs the above Rabbonim permitted the plaintiffs to file the case against Rubashkin, in court, to rescue the funds and the community from Rubashkin’s corrupt dictatorship.

The complaint voiced by Rubashkin’s supporters that it is forbidden to go to court because this can cause Rubashkin to go to Prison, is ridiculous:

First of all, anyone who voices such a compliant is himself admitting that in truth, according to Rubashkin’s Friends, knowledge, Rubashkin does indeed embezzle funds to such an extent that he is likely to get locked up for it by the authorities. If so, it’s incredible, how Segal who holds the above opinion of Rubashkin, can dare to continue to support him in spite of Segals implied admission that Rubashkin is guilty of gross embezzlement of community funds and corrupt dictatorship, control of the entire community.

Besides, if Rubashkin doesn’t want to go to Jail, he has an extremely simple solution: To go to a Din Torah by Zabla!

None of the Plaintiffs are interested in bringing Rubashkin to justice in court per say. The plaintiffs only intent is stop all the financial and communal, wrongdoing by Rubashkin period. It’s only because Rubashkin refuses a Din Torah by Zabla, which left the plaintiffs with no other choice but to proceed in court. But clearly, the second Rubashkin, actually, fully complies with a Din Torah of Zabla, the case against him could and would be dropped instantly.

The cliché used by the Rubashkin clique, that any attempt to stop Rubashkins Dictatorship; “Endangers Peace in C.H. and Destroys the Unity in C.H.” is ridiculous, primarily when it is heard from Segal, whose entire posture in the community holds the key to all of the divisiveness and Machlokes which dominates C.H. in recent months.

If Peace and Unity is so important to Segal, he should have the decency and respect to answer to the Call by Zikney Anash (Elder Chassidim). Segal should proclaim that since the Elections held by Rubashkin, we improper, without any sense of Justice and against the will of the majority of C.H., who boycotted the Elections, in protest –

(This Segal knows, all to well. In fact he himself participated in helping to structure the language of the Joint agreement to postpone the Elections and to be conducted by a neutral party and not by Rubashkin) –

Segal, out of all people, should be the first to say, that he doesn’t recognize these corrupt “elections” and therefore he is not undertaking any resulting communal position.

In general it’s absurd that a person like Segal who receives a salary of $30,000 per year, from non other than from Rubashkin himself, supposedly as a “Chaver Habadatz”, and he knows full well, that Rubashkin is withholding Rabbi Schwei’s Salary, only because, Rabbi Schwei doesn’t approve of Segal’s, improper involvement in the Badatz, it’s incredibly absurd that such a person like Segal should even mix in at all on behalf of and for the benefit of Rubashkin.

It’s even more absurd, that Segal, who himself refuses to appear to a Din Torah of Zabla, should even dare to preach to others about any concept of Torah Justice!

בראשית השבוע התראיין ר' שלמה סגל, לאתר ההשמצה והמחלוקת הידוע, כשהוא תוקף

במילים חריפות את חבר וועד הקהל הרה"ח ר' לייביש נאש, וקובע כי חל עליו דין "רודף", עם כל המשתמע מכך, היל"ת!

תושבי השכונה מאוד נבוכים מהעובדה שאדם שמתיימר להיות חבר הבד"צ – מוצא לנכון לרדת לכזו דיוטא תחתונה ולהתראיין לאתר שכזה, תוך שימוש במילים בוטות שאינן מתאימות לאדם המכבד את עצמו, ובוודאי שלא לאדם המעוניין להיות ביום מן הימים רב בישראל.

לא מדובר באדם אחד, אלא בקבוצה גדולה של אנ"ש תושבי השכונה שעומדים מאחרי הפנייה לבית המשפט, שמטרתה היא להציל את השכונה וכספי הציבור מהשתלטות של אדם יחיד, שעושה בכספי הקהל כרצונו, בלי שקיפות מינימלית. מדובר בהשתלטות נוסח פישר, שגם הוא העביר בשיטתיות את כספי הציבור לניהולו האישי ועשה בהם כרצונו, עד שקבוצת אברכים מאנ"ש התעוררה והוציאה אותו מניהול ענייני השכונה.

התביעה, שכאמור מגובה בקבוצה של עסקנים ואנ"ש מודאגים מתושבי השכונה, הוגשה בתחילה על ידי שני חברי וועד הקהל, הרה"ח ר' חנינא הכהן שפערלין והרה"ח ר' לייביש נאש. רק לאחר שר' ישעי' בוימלגרין התקשר לר' חנינא שפערלין ואיים שישקיע מליון דולר לחוקרים פרטיים על מנת למצוא בו דופי ולהלשין עליו לשלטונות, ור' משה רובשקין הצטרף גם הוא לאיומים, כשהוא מאיים גם על משפחתו המורחבת – נאלץ ר' חנינא להסיר את שמו מהתביעה, מחשש שהשניים יממשו את איומיהם ויעלילו עליו עלילות שווא לשלטונות.

יצויין, כי התובעים תבעו את רובשקין תחילה לדין תורה. בית הדין - שבהרכבו ישב המרא דאתרא וחבר הבד"צ, הרה"ג הרב אהרן יעקב שווי, ואתו עמו הרבנים הגאונים היושבים על מדין בבד"צ של השכונה כמה שנים, הרה"ג ניסן מנגל והרה"ג שמואל פסח בוגומילסקי – זימן את רובשקין לדין תורה, ואף איפשר לו להתדיין בפני זבל"א, אולם רובשקין בחר להתעלם מבית הדין, וסירב להגיע לדיון.

לא זו בלבד שלא הגיע לדיון, אלא שכדי להשיג מונופול בבית הדין, יזם רובשקין בחירות, ערך אותם נגד דעת רוב הציבור, במהלכים בלתי-דמוקרטיים בעליל, כולל זיופים בתוצאות הבחירות. כל זאת, על מנת להכניס את הרב סגל ועוד שנים מאנשיו לבית הדין, ובכך ליצור רוב מול הרב שווי, ולהתחמק מדין תורה. במהלכיו אלו, כידוע לכולם, גרם רובשקין לפילוג עצום בשכונה, כולל המימסד השכונתי - וועד הקהל וועד הנציגים. מסתבר, כי הפילוג העצום וההרס שהותיר בשכונה, לא מעניינים את רובשקין ואנשיו בדרך להשגת מטרותיו.

על מנת לקיים את דין התורה, שכאשר הנתבע מסרב לבוא לדין תורה, רשאים הדיינים להתיר לתובעו בערכאות, ומכיוון שמדובר בכסף רב של ממון-ציבור וניהול כושל של ענייני השכונה, התירו חברי בית הדין הנ"ל לתובעים להגיש את התביעה לבית משפט אזרחי, על מנת להציל עשוק מיד עושקו, דהיינו את שכונת קראון הייטס מידיו של ר' משה רובשקין.

הטענה שאסור לפנות לבית המשפט מכיוון שבעטייה עלול רובשקין לשבת בכלא היא טענה מגוחכת. קודם כל, מי שמשמיע טענה כזאת, מודה למעשה שלפי הידוע לו, רובשקין אכן מועל בכספי הציבור בסדר-גודל כזה שעלול לגרום למעצרו על ידי השלטונות. אם כן, תמוה מאוד שהרב סגל שסבור כך, ממשיך לתמוך ברובשקין למרות המעילות הגדולות שמעל בכספי הציבור. שנית, אם רובשקין אינו רוצה להגיע לבית הכלא, יש לו אפשרות פשוטה מאוד: להגיע לדין תורה! אף אחד מהתובעים לא רואה מטרה קדושה להביא את רובשקין לבית המשפט. המטרה היא להפסיק את הניהול הפוחז של כספי הציבור, וההנהגה הכושלת בענייני הקהילה הקדושה. רק לאחר שרובשקין סירב להגיע לבית הדין, לא נותרה לתובעים ברירה אחרת, אלא לתובעו לבית משפט אזרחי. אך ברור, שבכל רגע נתון יכול רובשקין להגיע לדין תורה תוך התחייבות לקבל את פסק הדין על פי תורה, ואיום המשפט האזרחי יוסר מעליו.

בכלל, מוזר שאדם המקבל מרובשקין 30,000 דולר בשנה למשכורתו בתור "חבר הבד"צ", ויודע שמזה חודשיים עצר רובשקין את משכורתו של הרב שוויי, מכיון שאינו מיישר קו עם מעשיו המפוקפקים – יתערב בכלל בעניין זה לטובתו של רובשקין. מוזר עוד יותר שאדם שבעצמו מסרב להגיע לדין תורה, ידבר על יושר מוסרי ותורני.

DaasHakohol and Rubashkin's Council has apparently been effective in persuading Rubashkin and his Renegade Netzigim, to abandon of their "Impeachment Attempt".

DaasHakohol has learned that Rubashkin's Council has advised them, to cancel Mondays Meeting for 3 reasons:

1) Since most Renegade Netzigim aren't willing to sit in Jail for Rubashkin, he can't even get a Quorum to attend his Illegal Netzigim meeting.

2) Rubashkin's Obstruction of Justice is likely to send him back to Fort Dix, since he is still on Probation.

3) Rubashkin's Impeachment Attempt is sure to anger the Judge and help make him loose the case.

In conclusion Rubashkin was advised that he should just pretend like he is trying an Impeachment Attempt, but nothing more than just pretending.

Rubashkin was advised to do this, by claiming that he has not "Canceled" the meeting but rather "only postponed" it until the 19th of the Month, which is Rubashkin's "Yom Hadin", in court.

Then on the 19th, he can then Lie once more and claim to "delay it" once more and so on, continuously - as Rubashkin has done in the past.

Failed Impeachment Attempt!

Netzigim could be Guilty of Obstruction of Justice, and face 5 years imprisonment if they attempt impeachment to stop the court case!

Rubashkin has been sending people, to intimidate those involved in the court case against him, saying that the case must be stopped at once so as not to uncover any of Rubashkin’s possible criminal activity which could be a violation of his current probation, resulting in his return to Fort Dix.

At the same time, while Rubashkin is trying to make a “Rachmones Case” out of himself, (that the case against him be dropped out of Rachmones for him,) at the same time he has relentlessly increased all his improper activity which has prompted the court case against him, to begin with.

It never stops to amaze people how someone who fears a violation of his parole and who criticizes others of alleged “Mesira”, yet he himself. Never stops jumping into the Fire, head on, relentlessly.

If their was any truth at all, that anyone is putting Rubashkin in danger, by taking him to court, certainly Rubashkin could just quit what he is doing and reverse the damage and the case would have been dropped against him.

The fact that not only has Rubashkin not backed down but he has increased his wrongful activity and all of Rubashkin’s Lawyers, Aids, Friends and Rabbi’s allow him to continue his reckless behavior, Have proven beyond a doubt, that no one really considers this to be a case of real “Mesira”.

The "Mesira Card" is obviously being falsely played in a desperate effort to discredit the inevitable winners of the current court case against Rubashkin.

Rubashkin’s most recent bizarre action has called for a meeting of his Illegal Renegade Netzigim to assemble in his home in attempt to impeach the Vaad Hakohol members who are taking him to court, for the sole reason that they have dared to take him to court.

This is in effect Rubashkins own Mesira on Himself!

Such action to deliberately undermine the Supreme Court, in such a Chutzpadik way, is sure to be considered the most brazen Obstruction of Justice, by the judge who is currently hearing the case.

Many Netzigim have already said that they will not risk attending this illegal meeting. One prominent Netzig has told DaasHakohol: “As much as I love Rubashkin, I am not ready to go to Jail for him”. Other Netzigim have also expressed similar sentiment.

At the very least, Rubashkin’s Impeachment Chutzpah, against the Judge, is sure to anger the Judge and help win the case against Rubashkin.

It is interesting to note that this is not the first time, that Rubashkin has “shot himself in the foot”. In the past criminal case against Rubashkin, his Brazen Chutzpah against the Judge in the courtroom, is what prompted the Judge to give him a much longer sentence in Fort Dix.

If Rubashkin has not yet learned his lesson from his past, perhaps, at least the Netzigim, will make sure that they can say “Yodeinu Loy Shofcha Es Hadam Hazeh” – to not lend a hand to help Rubashkin “jump into the fire”, Chutzpadik, against the Judge and the Pending case in court.

If Rubashin’s current actions are perceived to be “Suicide” for his own self interests, then at least the Netzigim should not be guilty of “Assisted Suicide”.

770 Talk - Shavuos 5766 – Anash Public Protest against Lush, Segal and Zirkind

770 was completely filled with men women and children who were awaiting to hear Krias Hatorah and the Aseres Hadibros, when once more Rubashkin and his sympathizers’, succeeded in turning this auspicious and joyous occasion into a blazing Machlokis and Protest scene in the presence of thousand of Rabbonim and Anash, in 770.

It all started, when Anash watched in horror, how the appointed Gabai for the day, Mr. Lush, a close ally of Rubashkin, exploited his position at the Bima to give two of the Aliyos, (traditionally reserved for the most respected members of the community,) to the two disputed candidates who lost the Elections, (to become the Rabbi’s of the community,) when 2/3 of the community stayed home to protest their attempted and failed election by Rubashkin and Company.

Everyone in 770 was thoroughly outraged at Lush, particularly in regards to his giving the Aliya to Segal, against whom their is not only a Siruv from Rabbi Schwei & Beis Din, but there is also a Psak Din (Rabbinical Ruling) by Rabbi Schwei & Beis Din which expressly prohibits giving any Aliya, at all to Segal, because of the Siruv against him. This Psak Din was prominently displayed in the Official Gaboim’s Letter Box, in 770.

As soon as Segal and Zirkind were given the Aliya, Several members of Anash publicly protested against this shameful act of giving Aliyos to people who masquerading as Elected Rabbi’s of the community, while in fact they are not. Especially against Segal who is also in contempt of Rabbinical Court to appear to Beis Din of Zabla to face the charges against him.

“They Are Not Rabbonim and that they should not be given Aliyos for the sole purpose to try and help them be perceived as though they were the Elected Rabbonim, which they are not”, Anash were protesting.

Krias Hatorah, at Aseres Hadibros, in 770 is the only time of the year, where not only is 770 filled with Men Women and Children, but in particular it is filled with all of the worlds greatest Lubavitcher Rabbonim from all 5 continents, who always make it a point to come to 770, on Shavuos.

The protest against Gabai Lush, giving Aliyos to those masquerading as Elected Rabbi’s, was very well received and applauded by the vast majority of Anash who agreed that the Gaboim have no right to take sides in the disput between the 2 Rabbonim.

After Davening, the first day of Shavuos and Shabbos at the Farbrengens, everyone was talking about it in 770.

Mashpiim pointed out that perhaps the most significant element of the Machoah, was the fact that it was done in front of all the most prominent Lubavitcher Rabbonim, from all over the world, and absolutely non of them protested against it, which clearly proves that this protest was officially accepted by all Rabbonim throughout the world.

Mashpiim quoted the famous saying of our sages: “Mideshasku Rabonon,…. Shma Mina D’Odu Ley”, Our sages say that Whenever a major event of great significance happens in front of many great Rabbonim and they remain silent, this means that they Approve. In this case, since no one protested against the Machoah, it clearly indicated that it has the unanimous approval of all of the hundreds of the world wide Lubavitch Rabbi’s who were present in 770 at this most auspicious moment of Aseres Hadibros!

It was for this very same reason, that the Rebbe himself had also voiced his own protest against the Gaboim of 770, several years ago, when the Rebbe said it was an Arkesa D’mesane, when Gaboim deliberately exploit giving the most prominent Alyos, to the wrong people, for the sole purpose of undermining the position of those who truly are the proper Elected Rabbonim.

Similarly, at the Main Farbrengen in 770, the second day of Shvuos, which is always attended by all of the greatest Lubavitcher Rabbonim from all over the world, many spoke out about a variety of issues. Rabbi Glukowsky from Israel, who is the main Secretary and coordinator of the entire Lubavitch Rabbinical organization of all of Israel, was also granted the opportunity to speak at this grand central farbrengen in 770.

Rabbi Glukowsky spoke about Shalom, Peace, in the community, which was understood by everyone to be referring specifically to the Rabbonim issues. However, even Rabbi Glukowsky, like all other world wide Rabbonim in 770, did not dare to criticize the public protest in 770, against Lush and against the Segal and Zirkind, which stated that they were not the elected Rabbonim and should not be treated as such.

The Grand Farbrengen in 770 on Shavuos was attended by Rabbi Schwei as ususual, however Rabbi Osdoba was not seen at this Farbrengen in 770 (nor at the previous Shabbos Achdus, farbrengen before Shavuos).

Renegade Netzigim Cancel Meeting at Last Minute

As reported on Daas HaKohol, the Rubashkin Renegade Netzigim called a Netzigim meeting for this past Tuesday, May 30.

At the last minute the meeting was canceled with no explanation.

Below is a letter that Daas HaKohol received (which likely playd a role in the sudden cancelation). It was written by a Netzig (who asked that his name not be publicized) to Yankel Wice, who called the meeting.

I am in receipt of a letter you sent me inviting me to a Netzigim meeting to take place on May 30 at the Shalom Center. I wish to notify you that I will not attend such a meeting since it is an illegal meeting for the following reasons. You are NOT the Chairman of the Netzigim and have no right to represent yourself as such and have no authority to call meetings. Therefore, the stationary used for the invitation, constitutes forgery and fraud.

Only the Chairman or secretary may send out notifications of meetings, regardless if meetings may be initiated by other parties as per the bylaws.The legally elected members of the Executive Committee are, Yisroel Best, Yisroel Sandhaus, Yisroel Landa, Mendel Schneerson and Mendel Shechter. Any meeting must be approved by those persons. Changing the stationary to reflect different names is an act of forgery and has legal consequences.

As for your meeting that took place in Rubashkin’s house that supposedly elected a new board, anything that took place there is null and void and has no legal basis to it whatsoever. Even if according to the bylaws the Chairman of the CHJCC has the right to call for a meeting, it does not give him the right to chair a Netzigim meeting . He also does not get to choose the time and venue of such a meeting. Any meeting would have to be arranged by the Executive Committee at the request of the Chairman of the CHJCC.

Even when the meeting has been arranged in the legally prescribed manner I have just described, he then would only be able to use the meeting for purposes that relate to the CHJCC/Vaad Hakohol. He has no right to meddle into internal matters of the Netzigim and definitely has no right to call for an election in an organization that he is not a member of. Elections for Netzigim are purely an internal matter which can not be performed by a member of the CHJCC or Vaad Hakohol ,and there are no bylaws giving him any such rights.

Besides that, according to the bylaws, elections are held once a year and a legal election was held in September of 2005. Also, many of those members in attendance of the illegal meeting are not even representatives of any Shul. They were just appointees of Moshe Rubashkin in his arbitrary manner. …. Therefore, for all of the above, your board is illegal and you have no right to call for any meetings and any actions or declarations you make are totally null and void.

In addition to the above legal reasons, you are also in violation of the Code of Jewish Law. You and your colleagues in this matter have been summoned to a Beis Din to answer charges for falsifying the stationary of the Netzigim and misrepresenting yourselves. The Beis Din has issued a preliminary injunction against you and your colleagues ordering you to refrain from any actions in the name of the Netzigim. It also recognizes the above named current Executive Committee as the only ones authorized to speak in the name of the Netzigim.

You are in contempt of Beis Din for violating the injunction, as well as for refusal to appear before the Beis Din or to appear at a binding arbitration acceptable by all parties known as a Zabla. At a meeting of the Netzigim that took place the past winter, you personally requested that your name be removed from the Complaint in Beis Din, saying that you agree to recognize the above-mentioned board and withdraw any challenge you may have had in the past. The minutes of the meeting will reflect that admission. By attending the meeting in Rubashkins house you have reneged on a commitment that was made in public and on the record, in addition to it being illegal by itself.

I therefore ask you to cease and desist from these illegal activities that are very divisive by nature, and is also a major cause of strife in our Community.

Gabboim Tally Victory in Court for Control of 770

The Gabboim and Krinsky were back in Court yesterday for verbal arguments over the control of 770.

Although the Judge did not give a ruling in Court yesterday, most observers feel that during verbal arguments the Judge made it clear that the Gabboim are in control of the shul in 770. This seems to put to rest the fear that R. Krinsky would be given control of the happenings downstairs.

R. Krinsky, on behalf of Aguch, owns the building, (the Gabboim had never disputed this). The only issue is who controls the outside of the building and the cornerstone that is mounted at the entrance. It is expected that a ruling will soon be given on this.

Anash Join Court Case Against Rubashkin

A number of community residents are adding their names to the Court Case as plaintiffs against Rubashkin. As details of the Court Case have been made public, many outraged residents are anxious to bring about an end to the machlokis. Since Moshe Rubashkin refuses to go to an impartial Beis Din they see the Court Case as the only method of putting an end to the current impasse.

Nash Explains Court Case

Leibish Nash was invited to a private parlor meeting to explain the Court case and answer questions. Here is a summary of what he said:

Nash began by explaining that the Court case was filed on behalf of the community and in the community's interest. He said that neither he nor Chanina Sperlin had anything personal to gain from the case. They feel that this is what will resolve the machlokis. They hope that Rubashkin will be forced to finally go to a Din Torah.

The court case asks for two things, the financial records of the Council and the Vaad, and the records of the election. In both cases these are things that everyone agrees should be given to them. They ignored four hazmonas to Beis Din and permission was given to go to court.

Someone asked a question about Mesira, that even if there was heter to go to court, you are charging fraud and things that could lead to jail, especially with Moshe's record. Nash responded that there were no criminal charges filed. The fraud is misusing stationary without authorization and paying for things that he decided on his own while claiming that he had authority, for instance. These details were necessary to justify getting the financial records.

Nash said that Moshe is on parole and that the details of his parole conditions are not public record. He said that he is confident that Moshe knows what he can and cannot do without breaking parole. He doesn't think that Moshe would be foolish enough to do something that would cause him to go to jail. Anyway, all Moshe has to do is go to Beis Din,which is what Nash was asking for from the beginning. Now they would want a lawyer's stipulation so that the Court would guarantee that he would keep his promise to go to a neutral Beis Din and that he would be made to follow their decisions.

Someone asked why they had to go to court to get the financial records, aren't they entitled to it because they are on the Board. Nash said that yes, they are entitled to it, but Moshe refuses to give them access to the books, and the employees are scared to disobey him. So he went to Beis Din and he believes any unbiased Beis Din would open the books to the rest of the Vaad, but Moshe refuses to go to a Din Torah. So he went to Court.

Someone asked why Moshe is being sued for $18 million, especially when the Jewish Week said the council's budget is only $2 million. Nash explained that an arbitrary amount is customarliy assigned to a lawsuit. In addition to the yearly budget there are council assets, etc. The idea is that Rubashkin should be accountable for his actions and not feel he can spend what he wants on his own. Until the books are looked at, he doesn't know how much money is involved that Moshe should pay back to the JCC.

Someone asked if the machlokis was worth it, shouldn't we just make peace? Nash said that since Rubashkin was elected he made every machlokis worse and created some where they never existed, like in the Vaad and the N'tzigim. He is of the opinion that no matter who gives in to Rubashkin he will just continue to make machlokis because that is who he is. The Court case is a last attempt at healing the machlokis and becoming one united communty instead of a split community.

770 News and Views – Shabbos Mevorchim Hachodesh Sivan - Shabbos Achdus!

The entire Shabbos in 770 was filled with an overwhelming atmosphere of Shalom and Achuds, where all Mashpiim were brainstorming ideas of how to bring about peace in our community.

Before Musaf, the speaker in 770 began his speech with a story from Rabbi Mindel who was called in by the Rebbe, and told him that he just received a Letter from a Jew in Sing Sing Prison. The Rebbe expressed great pain asking:

“What is a Jew Doing in Sing Sing Prison”?

The speaker connected it, to a Jew in the Midbar and to Shalom and Achdus.

After Davening, Mashpiim in 770, Farbrenged the entire Shabbos, to try and find ways to make Sholom between the Rabbonim and the entire community who are divided, taking on different sides of the Machlokes.

The Call for Peace and Compromise was loud, clear and unanimous, but it remains to be seen if the Rubashkin hardliners will be willing to compromise and reach a lasting agreement.

Everyone at the Frbrengen agreed that the best chance for peace was the fair and equitable agreement reached on Apr. 30^th to cancel the illegal elections. Although both sides signed the agreement before the elections, yet Rubashkin’s side refused to honor the agreement signed by their own people, on Election Day.

After Mincha in 770:

Rabbi Y.Y. Jacobson spoke at the special Kinus Achdus Farbrengen where all Anash assembled to unite in accordance with the Rebbe’s Bakasha Nafshis:

Rabbi Jacobson told many stories on the theme of Achdus, while speaking out publicly against the current Machlokes of the Rabbonim. He said in the name of Rabbi Marlow that all Machlokes stems from the desire for Money and Kovod (i.e. Power) and that it wasn’t worth having the entire community destroyed, for this and that a compromise must be reached at once.

Rabbi Jacobson pointed out that Yidden have always had their differences but settled matters at an impartial Beis Din who sometimes decided who is absolutely right and who is wrong and sometimes the Beis Din would reach a Pshara – a fair compromise.

Everyone listening to the Farbrengen, said that Rabbi Jacobson was right and the only reason the Machlokes is unsolvable in CH, today, is only because Rubashkin an his team have so far refused all reasonable efforts at peace and compromise, including a call to a Din Torah by an impartial Beis Din of Zabla which resulted in the Beis Din issuing a Psak Din against Rubashkin, to permit having him sued in court.

Board members say chairman owes council millions; Rubashkin claims row is over bet din.

A state court in Brooklyn is weighing whether to require the chairman of the Crown Heights Jewish Community Council to turn over financial records to his officers after two directors alleged that he has misdirected funds for personal gain.

But Rabbi Moshe Rubashkin emphatically denies the charges, insisting 'not a dollar, not 50 cents, not a penny' was misused. And at least one communal leader says the charges appear 'baseless.'

Judge Francois Rivera of state Supreme Court earlier this month called on Rabbi Rubashkin to show why an order should not be issued by the court requiring him to open the books. The motion also prevented the installation of three rabbis to a bet din whose election on April 30 is in dispute.

The two board members, Hanina Sperlin and Leibish Nash, want Rabbi Rubashkin to give up financial control of the council and pay at least $18 million to the organization.

A hearing in the case was scheduled for Monday but postponed until June 19 before Judge Michael Ambrosio, at which time the rabbi will have to explain why he should not have to show the records to the plaintiffs.

The case reveals a hefty power struggle within the tangled web of secular social service and religious organizations that controls life in the Crown Heights chasidic community, whose numbers are estimated at about 10,000. Thousands more adherents who look to Crown Heights for guidance are spread across the globe.

Rabbi Rubashkin’s election to the helm of the JCC, which disburses public and private money to those eligible for social programs while also funding neighborhood projects, drew some controversy in January 2005, because he had served 15 months in a federal prison two years earlier for writing bad checks to cover expenses for his failing textiles business.

He was nevertheless elected with more than 70 percent of 1,200 votes cast, more than the others on the slate. His supporters later said he would not be directly involved in the JCC’s finances.

But Sperlin and Nash allege that not only is he involved but “it appears that Rubashkin has used JCC funds for his own self-interest and personal expenses” while refusing to open the books to other trustees and bypassing other officers, according to court papers.

No details are provided in court papers about the alleged misdirection of funds. The plaintiffs are seeking “at least $18 million” to be repaid to the JCC, according to court papers, although the same papers elsewhere note that the organization’s assets are around $2 million.

“We are afraid his actions could affect the city’s funding to the JCC,” said the plaintiffs’ lawyer, Howard Rubin.

Rubin told The Jewish Week the suit was brought because Rabbi Rubashkin “unilaterally” scheduled an election to fill a vacancy on the communal bet din through a process that violated the JCC’s mandates, in the view of the plaintiffs.

“The clients came to us and said this is not according to bylaws and rules and successfully got a temporary restraining order preventing the certification of the election,” said Rubin. “In the course of an investigation we found out Rubashkin was using the letterhead of the JCC as if the election was approved by the JCC or the Vaad Hakohol.

”The Vaad Hakohol is the JCC’s religious arm, which carries out the elections of the bet din.

In an interview from Israel, where he was visiting his son this week, Rabbi Rubashkin spoke in great detail about the case, insisting the true aim of the plaintiffs was to prevent the installation of the rabbis to the bet din. He said he did not know why the plaintiffs opposed the rabbis.

“I don’t understand what they are trying to do,” he said. “They are coming at me from every which way. This isn’t about Moshe Rubashkin. What they really want in court is to stop the rabbanim [rabbis] from becoming rabbanim. That’s what they’re looking to stop.” He stressed that a vibrant communal bet din, which would interpret the teachings of the late Rebbe Menachem Schneerson, was imperative in a movement that dispatches thousands of emissaries throughout the world.

Of his past indiscretions, Rabbi Rubashkin said “I made a mistake in my life and paid a very heavy price for it, but paying the price doesn’t mean you are killed. Last year 450 people went to camp [thanks to the JCC], we gave out money like never before in the history of the JCC.” He added that he receives no compensation for his work with the council. He also insisted that the council’s books must be examined by government audits. “As long as you take any money from the government you must certify the books every year.

”The JCC is affiliated with the Metropolitan Council on Jewish Poverty, which administers some of its programs, such as Child Health Plus and job training and prepares the payroll of employees who work on those programs, although it does not directly fund the JCC.

Met Council’s director, William Rapfogel, said his inquiries into the matter suggest personality clashes were mostly to blame for the strife.

“We’re always concerned about any kind of allegations,” he said. “But based on initial discussions these seem to be baseless charges purely based on disagreements within the community. They have to do with a bigger machlokes [conflict], which has nothing to do with the provision of social services.

”Rabbi Rubashkin’s critics object to his spending thousands of dollars on an outside firm, Election Services Corporation, to certify the results of the election. The rabbi says the sum was about $15,000. He said the expense was justified to ensure that the results would not be questioned. But, in the court papers, the plaintiffs, who named Long Island-based Election Services Corporation a co-defendant in the suit, claim the election was not carried out in accordance with Vaad Hakohol guidelines, which require, among other things, that the tallying of results be videotaped. The lawsuit claims the company certified the election “notwithstanding the fact that it was informed that the election was not performed properly.

”Election Services Corporation, as of Tuesday, did not respond to a call and e-mail message seeking comment.

The lawsuit also claims that Rabbi Rubashkin held a meeting in his home last month to appoint new members of the JCC board — members who would support his stewardship — and that meeting violated the group’s bylaws. But the rabbi said his election was held to address violations of bylaws in the last election in September.

Marcia Eisenberg of the Jewish Legal Assistance Program, a division of the Jewish Community Relations Council that advises nonprofits, said she had been consulted on the dispute and had informed both sides that they had not conformed with JCC bylaws. She said the April meeting was likely held too far after the initial election to supersede it.

“If they did everything they say they did and adhered to the bylaws, the question is was it legitimate because it was done in April,” said Eisenberg.

Yankel Wice, a member of the JCC’s synagogue advisory council who supports Rabbi Rubashkin, said he “strongly doubts” the rabbi did anything improper.

“He has done things like provide clothing and housing for yeshiva boys and girls on Passover and helped with summer camp tuition and a lot of social programs, often using the monies that the council has,” said Wice. He insisted Rabbi Rubashkin had provided some accounting of the finances, if not to the level sought by his detractors. “What the plaintiffs in this case are seeking is every single record, every petty cash [receipt] and check stub. I am not aware of any organization that is required to provide that level of specificity.”

At the Court Hearing today, here is what occurred:

Rubashkin's lawyer, Michael Berger, presented a letter from Rabbi's Osdoba, Raitport and Segal, (a copy of this letter is not available because it was not made part of the Court record), and asked that the case be removed from Court. The Judge did not grant this request.

Rubashkin's lawyer then asked for more time to answer the charges. The request was granted and the next hearing is scheduled for June 19.

The injunction against installing the newly elected Rabbonim remains in effect until the next hearing on June 19.

The owner of the election service came without a lawyer and said he needed more time to get a lawyer, which was given.

Evaluation: No surprises, the request for more time was granted and the injunction remains in place in the meantime. The next hearing will be more meaningful.

Amidst reports of heavy negotiations taking place to move the Court Case to Beis Din, Daas HaKohol has received reports that the Rubashkin Netzigim have called a Netzigim meeting.

Since this violates the ikul of the B'Datz under Rav Schwei, (and perhaps an ikul of Rav Osdoba as well), this plunges the community right back into machlokis in the streets. What effect this will have on the Court Case negotiations is not yet known.

It was a very lively Farbrengen in 770 yesterday where people in 770, as well as most other shuls and Mikva's in C.H. discussed the unfolding Scandal of corruption, mentioned in the Court Papers against Rubashkin and Company.

Everyone was saying that Rubashkin, Brook, Boimelgreen and the rest of the group are absolutely petrified of having no choice now, but to show the books, as a result of the court papers filed. Some people questioned why it had to come to this and why Rubashkin and company are so scared to show the books, "What are they hiding?" they asked.

Most people in 770 and other Shuls, could not stop thanking Chanina Sperlin and Leibish Nash for having filed the papers in court since "Talking Nicely" to Rubashkin and even repeated calls for a Din Torah were denied by Rubashkin and all his supporters.

All prior calls for making "Shalom" were denied by Rubashkin and all his supporters and even when they were "approved" they defaulted on all their written contract "peace agreements" which they pledged. Obviously they were "Asking for It", to go to Court and "they got what they asked for".

Being aware that they stand no chance of any possible legitimate defense, in court, they are desperately trying to strike a "peace" agreement, as long as it will be taken out of court immediately. But so far they are not really ready to let go of all of their corruption yet and no one is going to fall for a deal where they will likely come back a few minutes later, saying that, "I decided" that "I changed my mind", as they did on the Election Day Contract, Peace Deal, to cancel the elections.

The fact that the Rubaskin's team did not honor their written contract agreement for "peace", on Election Day, they have effectively lost all credibility for "peace" and now, only the courts will have to force justice, without any bias.

Some people in 770, defended, not showing the books, saying that "everyone has things to hide" and Rubashkin isn't any more guilty, than any one else because "they all do the same thing".

Heard in the Mikveh: Before the court case everyone was fighting. Now they are all of a sudden talking about making peace and coming up with ways to go to Beis Din. This is the way it should be. As Directed by the Beis Din of Three Rabbonim, including the Mara Deasra, Harav Schwei Shelita, Abir Shebeabirim (According to the Rebbe) - who issued a Psak Din, that Moshe Rubashkin may be taken to court because of him being in Contempt of Rabbinical Court for failure to appear for a Din Torah - Papers have now been filed against Rubashkin in the Supreme Court of the State of N.Y., dated May 15th, Erev Lag B'Omer.

Monday Night Lag B'Omer - Illegitimately Elected Candidates Served with Hazmonos (Rabbinical Subpoena) by Beis Din

Earlier in the day, Erev Lag B'Omer, A Hazmana (Rabbinical Subpoena) has been issued calling the above 3, illegitimately elected candidates, to a Din Torah.

The Hazomono's against them were issued only after an exhaustive effort was made, by many elder Chassidim, to arrange for a peaceful settlement (see our previous post for complete details). Had they accepted the settlement it would have resulted in a lasting peace in the Badaz. Instead they chose to reject peace and they now face very serious charges in the Beis Din.

Late this evening, Lag B'Omer, about Maariv time, they were actually Served with the Hazmonas, which now Halachicaly requires them to appear to Beis Din for a Din Torah. Should they fail to appear, they will likely be Sanctioned by the Beis Din who will issue a Siruv Against them.

Should they fail to cooperate with the Subpoena (Hazmona) to a Din Torah, in addition to the "Siruv" (comparable to a Order of Contempt of Court) the Beis Din also has the right to issue a "Cherem" against them (Excommunication) as they have done with Fisher, when he refused to appear for a Din Torah.

A large group of Zikney Hachassidim wrote a beautiful letter calling on the "elected candidates" to unite in an effort for true peace in the Badatz.

In their letter they explain that the Rebbe supported Elections which are Fair and Impartial because only then can the community be united since no one can challenge the legitimacy of a Fair Election. The last "election" held on Apr 30th was so ridiculously unfair that even Children are laughing at it and it will never be recognized by the vast majority of the community and the fire of the Machlokes will continue to divide the community forever Chas V'Sholom.

There were several meetings scheduled with Zirkind in the last few days, including several meetings scheduled, Yesterday, Sunday and each time they were to have a meeting, Zirkind said "he was too busy" and kept on pushing it off.

Late Sunday Night after countless tries it was apparent that they are not at all interested in peace and only "Other Means" will have to be used, to deal with them, for justice to prevail as the Rebbe wanted it in C.H.

Although Zirkind refused all calls for peace, he is by no means a "Happy Camper" with Rubashkin's corruption team, either. As of Erev Lag B'Omer, it was rumored that Zirkind will Boycott the so called "Hachtorah" i.e. "Crowning" of the illegitimately elected individuals, on Monday Night in 770. We will likely not know for sure, if Zirkind will strike a last minute deal with Rubashkin and Company, until late Monday Night.

NEWS SCOOP - Rabbi Osdoba's Reason for not keeping his Signed Binding Agreemnet regrding Cancelations of Apr 30th Elections

In an interview with Rabbi Osdoba to be published in the Crown Heights Chronicle, later this week, Yitzchok Wagshul intervied Rabbi Osdoba, as to why he did not keep his signed and binding agreement with his fellow Mara Deasra, Harav Schwei Shelita.

Rabbi Osdoba's reply:

According to Yitzchok Wagshul, Rabbi Osdoba said:

"He was surprised that anyone should consider it strange that he changed his mind and ultimately favored not delaying the election, since that had been his position from the start."

According to Wagshul Rabbi Osdoba explained that:

"He had only signed the second document (agreeing to postpone the election) because the candidates themselves had called him and pleaded with him to do so, on the ground that they were being harassed over the controversy, and he felt that he could not ask them to accept such hardship. However, Rabbi Osdoba continued, later in the morning Mr. Rubashkin had brought the candidates themselves to him, and they had personally expressed their readiness to proceed. Under those circumstances, concluded the Rov, he saw no reason not to reaffirm his position all along, which was that the election should proceed."

DaasHakohol.com, staff expressed surprise at Wagshul's report because it is inconsistent with Rabbi Osdoba's own words in his own handwriting (See Photos below) where he uses the words (in Hebrew and in the Translated letter in English) that the reason he "changed his mind" was because:

"Whereas there was a misunderstanding with regard to the structure of the elections"

Eliyahu Poltorak, affirmed under penalty of perjury, that "at no point was the structure of the elections ever mentioned", when he negotiated with the Candidates nor was it ever mentioned by Rabbi Osdoba.

Wagshul's explanations, only ads further confusion and doubt as to what in fact really happened. Who called the Shots? Who did the "Arm Twisting" to make people change their minds and violate their Signed, Halachicaly and Legally, Binding Contract Agreement, to Cancel the Elections.

Poltorak response to Wagshul was that Wagshul's report, simply is inconsistent with all of his first hand information and that of many witnesses who can testify that:

1) "The structure of the elections" was never an issue with anyone.

2) Segal, never changed his mind, even after Rabbi Osdoba canceled his agreement. Segal told Eliyahu Poltorak that he should not waste his time negotiating with the Rabbonim, any more, but to negotiate with Boimelgreen instead. When Poltorak expressed Shock, asking Segal: "Who makes the decisions over here, the Rabbonim or the Money Men?", Segal, who was visibly upset at Rabbi Osdoba's reversal, responded, you "go an see for yourself".

3) Long after Rabbi Osdoba changed his mind, later in the day, that same Sunday, Zirkind, actually thanked Poltorak for his effort and at no point (before or after Rabbi Osdoba's cancellation of his agreement), did Zirkind ever mention any issue regarding any "Structure of the Elections" nor did Zirkind ever mention to anyone, that he ever changed his mind regrading his original, agreed upon cancellation, of elections.

The above testimony from Eliyahu Poltorak and countless witnesses, is indicative that their never were, any such candidates, who ever "changed their minds" and lends credibility, to the many eye witness reports, who say that it was in fact Boimlgreen's "Arm Twisting" which caused the cancelations of the contract agreement to cancel the elections.

Even Wagshul, in his paper to be released later this week, failed to provide any reports from any of the Candidates who could have said On Record, that it was their own "Mind Changing" which in turn, cased Rabbi Osdoba, to reverse his pror position.

Renegade Netzigim Violate B'Datz Injunction

In the announcement of the "election" results that came on Netzigim letterhead, the netzigim listed as the Executive Board are the ones put in by Rubashkin. This violates the Ikul, injunction, of both Rav Osdoba and Rav Schwei.

Histoy From a Prior Post

Rubashkin made a meeting in his house and called Netzigim. He then made a vote for a new Executive Board. "Elected" were Yankel Wice, Chairman, Benny Raskin, Vice-Chairman, Reuven Lipkind, Treasurer, and Moshe Haber and Alex Weiscz,Secretaries.

Objections:

1. Rubashkin is no longer the Chairman of the Vaad and cannot call Netzigim meetings because he was removed from the Vaad by the Bais Din for not listening to three hazmonas.

2. There is an ikul in effect not to change the status quo until the Din Torah is heard. There are actually two injunctions, one signed by Rabbonim Gurary, Bogomilski and Mangel. The other signed by Rav Osdoba.

3. There was no quorum as several of the people who came were not valid netzigim.
4. Several of the netzigim who came were under orders from their shul not to participate, so they were there illegally.

5. Rubashkin's motivation is simply to avoid being impeached. He doesn't mind bringing down the community, as long as he is saved.

After the meeting in his house at which the renegade Netzigim were "elected", when Rubashkin was reminded of the ikul, he seemed surprised. Later he claimed that he persuaded Rav Osdoba to remove the ikul - after the meeting had already taken place.

It turns out this story was a pretty good guide for what happened with the Rabbonim: A bogus election marked by the Rav changing his mind at the last minute. Also, in both cases, Rubashkin's motivation is clear: to put in his own people who he can control, so that he can do whatever he wants.

I reside at 888 Montgomery St. in the neighborhood of Crown Heights. I am a part of the Crown Heights Jewish Community, governed by the Beth Din (rabbinic court) of Crown Heights (the “Beth Din”) and the Vaad Hakahal, a.k.a. the Crown Heights Jewish Community Council (“CHJCC”). Being a married male I am eligible to vote in communal elections governed by the bylaws of the CHJCC.

The Beis Din of Crown Heights has three elected members: Rabbi Yosef Heller, Rabbi Avrohom Osdoba, and Rabbi Yakov Schwei. Rabbi Heller has recused himself from all communal affairs. Over the past three years a rift has developed between Rabbis Osdoba and Schwei creating deadlock on the Beis Din. Rabbi Heller has refused to intervene or to take sides between them. This has resulted in open warfare between the aforementioned rabbis.

Several months ago, Moshe Rubashkin, the Chairman of the Board of CHJCC announced his intention of holding new elections for additional rabbis to serve on the Beth Din.

Mr. Rubashkin has demonstrated time and again that his loyalties lie with Rabbi Osdoba and that he wishes to push Rabbi Schwei out of the Beis Din. See, Exhibits ??

Rabbi Schwei refused to give his approval to this election and announced a ban on participating therein. Rabbi Osdoba lent his support to these elections.

The candidates up for election are all supporters of Rabbi Osdoba’s camp.

Several weeks ago, I began sensing a deep and bitter divide in the community in the run-up to the elections. Having recently graduated from the Columbia University School of Law (my admission to the bar is pending), I decided to put my negotiating skills to use in attempting to mediate between the parties so as to avoid a tragic split in the community.

Up until these events, I had no direct involvement in this conflict. (In fact, my sympathies lay with Rabbi Osdoba, who has served on the Beis Din far longer than has Rabbi Schwei; I publicly urged friends and acquaintances to vote in this election despite the ban by Rabbi Schwei, because I believed elections to be the only way out of the stalemate paralyzing the Beis Din and by extension, the community.) Therefore, I was able to establish a rapport with key players on both sides of this dispute.

When I first began discussing possibilities for a mutually acceptable settlement, I became aware of the fact that, despite Mr. Rubashkin’s assertions to the contrary {SEE EXHIBIT????}, Rabbi Schwei’s camp supported free and fair elections. Their primary objection was to Mr. Rubashkin’s handling of the election in an illegitimate manner.

Last Thursday, April 27th, I negotiated with Mr. Rubashkin all night and hammered out the following proposal: 1) That elections be held within approximately 6 weeks; 2) that the current candidates would be allowed to run, in addition to anyone nominated by Rabbi Schwei; 3) That Rabbi Schwei could pick someone of his choosing to administer the elections.

Avrohom Silver, a key figure in Rabbi Osdoba’s camp, was present throughout most of our negotiations and heard Mr. Rubashkin make this offer.

When I asked Mr. Rubashkin to sign the scrap paper I had outlined the offer on, he reacted with outraged indignity, taking offense at my lack of trust in him.

Upon returning from the meeting at approximately 5 A.M., I e-mailed the terms of the offer to Jacob Herzog, a former chairman of the CHJCC and a key figure in Rabbi Schwei’s camp. {SEE EXHIBIT????} Friday morning, Mr. Herzog replied that he would consider the offer. {SEE EXHIBIT????}

At approximately 1 P.M. I spoke to Mr. Rubashkin and he reassured me that he stood by his offer.

After conferring with his associates, Mr. Herzog accepted the offer at approximately 2 P.M.
I then returned to Mr. Rubashkin and notified him that his offer had been accepted. Mr. Rubashkin replied that at 12:15 P.M., he had spoken via telephone to Rabbi Osdoba regarding an idea suggested by Mendy Hendel earlier that morning. Mr. Hendel had suggested that all concerned parties (i.e., the current members of the Beis Din, their advisers, and the candidates, gather in different rooms in the CHJCC and adjoining Beth Din offices Saturday night, and that several neutral people could then shuttle between them to hammer out a deal.

In reply to this suggestion, Rabbi Osdoba stated his intention to spend the Sabbath with his son’s family in Belle Harbor, Queens and not to return until Sunday. According to Mr. Rubashkin, having heard the rabbi’s belligerent stand regarding negotiations, there was no further room for any agreement.

I then approached Dr. Tzvi Lang, board member of the CHJCC, and attempted to enlist him in support of the deal. Dr. Lang replied: “Whatever Moshe [Rubashkin] says is fine with me.”
On Saturday night, I paid a visit to Rabbi Shlomo Segal, along with Rabbi Pinchas Korf, Rabbi Yekutiel Rap, and Joseph Katzman. All three identified to varying degrees with Rabbi Osdoba’s camp prior to the events described herein. Joseph Katzman is one of Rabbi Osdoba’s most vocal supporters.

We proceeded to explain to Rabbi Segal at length the tragic consequences of continuing with an election rejected by at least half the community. Such action would surely result in a split-up with Rabbi Schwei forming his own Beis Din, leading to an irreversible schism in the community. We also explained to him that it would be in his personal interests to agree to the terms of the offer I had brokered, as then he could run in several weeks and be elected in an undisputed election, rather than in an election rejected by the majority of the community. Rabbi Segal agreed to push for a deal and promised to contact me shortly.

After an hour I had not yet heard back so I telephoned Rabbi Segal. He informed me that he would be meeting shortly with Rabbi Osdoba and Rabbi Zirkind (another candidate). He further stated that Rabbi Osdoba does not trust Rabbi Schwei’s intentions and that he could do nothing to promote the proposed agreement until I had it signed by Rabbi Schwei. I replied that Rabbi Schwei would have to be crazy to sign an agreement binding himself, before the opposing camp even agreed to the deal. He replied that in that case there was nothing he could do. I then suggested a compromise—that I obtain Rabbi Schwei’s signature on the agreement which I would then hold pending Rabbi Osdoba’s decision, and that I provide him with an unsigned copy of the agreement, identical to that which Rabbi Schwei had signed. Rabbi Segal agreed to these terms.

I then drafted an agreement, contacted Rabbi Schwei’s close advisers, and asked them to obtain his signature on the agreement, which they did. See, Exhibit ?

The agreement was written in Hebrew. It stated that: The two undersigned rabbis agree to postpone tomorrow’s election under the following conditions:

1)The elections will take place by June 18th of this year.

2) A neutral third party will administer the elections, and the Community Council will not be involved at all.

3) Either of the two rabbis will be able to approve a candidate and the other rabbi will not be able to challenge him.

4)The elections will take place under the same conditions as presently—i.e., each voter will be allowed to choose whether to vote for 1, 2, or 3 candidates and every candidate receiving more than 50% of votes cast will be elected to the Beth Din.

This represented the offer I had obtained from Mr. Rubashkin, with two minor modifications in his favor: Firstly, I modified the clause calling for Rabbi Schwei to appoint the administrator of the election, calling instead for an independent administrator, so as to avoid accusations of impropriety. Secondly, I modified the clause allowing Rabbi Schwei to add any candidate he wished to the current candidates, to allow either rabbi to approve any candidate he wished with no veto right by the other rabbi. This would allow the three current candidates to run, in addition to any other candidates approved by either Rabbi Schwei or Rabbi Osdoba.

I then delivered several unsigned copies of the agreement to the meeting taking place at Mr. Rubashkin’s house. Mr. Rubashkin, Rabbi Segal, Rabbi Zirkind, and Mr. Silver were present at this meeting. Rabbi Osdoba was not present. I handed the papers to Rabbi Segal, while assuring him that the signed copy was in my possession.

After approximately one hour, I again telephoned Rabbi Segal. He informed me that he was unable to reach Rabbi Osdoba and so could not finalize the deal. We had a lengthy conversation in which I made clear to him that it would be far more difficult, if not impossible, to reach an agreement once the balloting had begun. He replied that he could not commit himself without Rabbi Osdoba’s approval and that perhaps that approval could be obtained in the morning.
Over the course of the night, I contacted Rabbi Shmuel Plotkin, board member of the CHJCC, who was then in Miami. He refused to consider my proposal, telling me to talk to Mr. Rubashkin, as he is the one making decisions.

At approximately 7 A.M., I contacted Rabbi Zirkind, with Rabbi Rap also on the line, and described the proposed agreement to him. (I assume Rabbi Segal showed him the agreement at their meeting.) Rabbi Zirkind replied, “I’m all for it.” He also informed us that he had yet to go to sleep and that he had spent the night pushing for a compromise agreement. I then informed him that I was heading toward Belle Harbor to try to obtain Rabbi Osdoba’s signature. He responded with strong encouragement.

I then drove to Belle Harbor with Rabbis Rap and Korf, both of whom had accompanied me to the previous night’s meeting with Rabbi Segal. On the way, Rabbi Rap telephoned Rabbi Segal and informed him of our plans. Rabbi Segal encouraged us to close the deal with Rabbi Osdoba and offered to speak to Rabbi Osdoba to urge him to sign.

We had difficulty locating Rabbi Osdoba’s son’s home and did not arrive until approximately 7:40. The election was scheduled to begin at 8. Rabbi Osdobo came to the door and informed us that he did not have time to speak as he was running late to prayer services. I handed him an unsigned copy of the agreement and informed him that Rabbis Segal and Zirkind were strongly in favor of the deal. He then telephoned Rabbi Segal who urged him to sign. I then handed Rabbi Osdoba the phone with Joseph Katzman on the line. He too urged Rabbi Osdoba to sign the agreement. Rabbi Osdoba also called Mr. Rubashkin, but despite repeated attempts Mr. Rubashkin did not answer the call.

At approximately 7:55 A.M. Rabbi Osdoba agreed to sign. I then retrieved the copy signed by Rabbi Schwei from my vehicle and handed it to Rabbi Osdoba. Rabbi Osdoba refused to “sign the same page as him [Rabbi Schwei]” and proceeded to sign the unsigned copy I had handed him earlier, which he then handed to me. See, Exhibit ?

At that point, Mr. Rubashkin called back. When Rabbi Osdoba informed him that he had signed the agreement, Mr. Rubashkin began shouting frantically. I was not able to make out what he was saying other than that Rabbi Schwei’s signature was forged. I assured Rabbi Osdoba that the signature was authentic and he accepted my assurances. Rabbi Osdoba reassured Mr. Rubashkin by saying that he could still take back the signed agreement from me.

Mr. Rubashkin continued his frenzied shouting. Rabbi Osdoba responded to Mr. Rubashkin by curtly informing him that he was late for morning services and had no time to talk to him. Rabbi Osdoba concluded by saying words to the effect of, “The candidates themselves do not want to run in an election like this. Rabbi Zirkind kept me on the phone all night saying that he want to withdraw. What do you want from me? I already signed the agreement cancelling the elections. I cannot forbid you from carrying on as Rabbi Schwei has banned this election and I cannot do anything he does, so do whatever you want.” He then hung up the telephone and rushed off to morning services.

I then telephoned Rabbi Segal to inform him of the deal. He stated that he had been on the line with Mr. Rubashkin and Rabbi Osdoba, so he was up to date. He further informed me that Mr. Rubashkin had promised to delay opening the polls by several hours. After Rabbi Osdoba finished the morning services, Mr. Rubashkin would once again confer with him as to cancelling the election altogether. Rabbi Segal concluded by saying, “this is a great thing that you have accomplished.”

Several minutes later, I received a telephone call informing me that balloting had begun. I then once again telephoned Rabbi Segal to ask him what was going on. He reacted with shock and promised to get back to me shortly.

I then returned to Crown Heights, photocopied the agreement, and proceeded to the polling station in the central synagogue at 770 Eastern Parkway. I handed copies of the agreement to Mr. Rubashkin and his associates, as well as bystanders. Mr. Rubashkin loudly proclaimed the agreement a forgery, claiming that I had forged Rabbi Osdoba’s signature.

At approximately 9:30, I telephoned Rabbi Zirkind, informing him of what had transpired in the time since we had spoken. He reacted with furious outrage at the fact that Mr. Rubashkin had opened the polls despite the agreement between the rabbis. He asked me to hand my phone to Mr. Rubashkin. Mr. Rubashkin grabbed the phone out of my hand and flung it violently into a metal garbage bin, causing damage to the phone. I then telephoned Rabbi Zirkind once again. He replied that he was on his way over.

Minutes later he arrived and proceeded angrily toward Mr. Rubashkin. After conferring with Mr. Rubashkin for several minutes he returned to me and asked to see the agreement. I produced both copies of the agreement, signed by the two rabbis. Rabbi Zirkind responded by loudly proclaiming them a forgery. When questioned as to why he considered them forged, he responded that the two rabbis had not signed on the same page. I then informed him that Rabbi Osdoba had in fact refused to sign the same page as Rabbi Schwei. He ignored what I said and returned home.

I then telephoned Rabbi Segal once more, informing him that Rabbi Schwei’s circle was furious at the breach of the agreement and that unless the polls were closed immediately, they would no longer consider themselves bound by it. Rabbi Segal responded that the election is “a nullity,” and that it “has no force whatsoever,” so it didn’t really matter whether the polls closed or not. He went on to assure me that Rabbi Osdoba was on his way back from Belle Harbor and that he would make sure that Mr. Rubashkin closed the polls.

While I was distributing photocopies of the agreement, Rabbi Plotkin forcibly grabbed the pile of papers and attempted to seize them from my hands.

At approximately 10:45 Dr. Lang began telling bystanders that Rabbi Osdoba had agreed to continue the election. I then telephoned Rabbi Osdoba’s office. My call was answered by his son, Rabbi Yakov Osdoba. I asked him to clarify matters and to ask his father to please telephone me. He called me back several minutes later saying that he had spoken to his father, who was then teaching a class at Yeshiva Hadar Hatorah, and that his father stated that this was not really an election but rather “a poll of public opinion” and “a primary.”

I then telephoned Rabbi Segal once again and stated that the state of affairs made a mockery of Rabbi Osdoba and that it was his responsibility to come to the scene and close the polling station. He replied that Benny Raskin was on the way to Rabbi Schwei to obtain his signature on the page Rabbi Osdoba had signed so as to assuage Rabbi Zirkind’s concern. He assured me that the election would be halted within the hour and that the votes were null and void.

Minutes after I had spoken to Rabbi Segal, a bystander telephoned him and asked whether the elections would be postponed. He responded that “a decision has not yet been reached.”

Approximately an hour later, I once again contacted Rabbi Segal and asked him why the election had not yet been cancelled. He answered that Mr. Raskin had not in fact approached Rabbi Schwei. Rabbi Segal then urged me to approach Rabbi Schwei myself to obtain his signature on the same page as Rabbi Osdoba. When I asked why he was going along with this nonsense, despite the fact that he had firsthand knowledge of the circumstances of Rabbi Osdoba’s signing, he replied that he has to respect Rabbi Zirkind’s opinion. I initially refused to return to Rabbi Schwei after such a mockery had been made of this agreement. Nevertheless, I relented and promised to obtain the signature on the condition that Rabbi Segal promise me that he would personally shut down the balloting. Rabbi Segal agreed and promised to do so as soon as I had the signature.

I then proceeded to Rabbi Schwei’s house. Rabbi Schwei was shocked at the strange request and stated that this was a charade. He expressed his outrage that Rabbi Osdoba’s camp was unjustifiably using the separate signatures as an excuse for ignoring the agreement, despite the fact that it was Rabbi Osdoba himself who refused to sign the same page as Rabbi Schwei.
While he was deliberating whether to sign the page with Rabbi Osdoba’s signature, despite the opposing side’s blatant disregard for the signed agreement, I was notified that Dr. Lang had announced in the central synagogue that Rabbi Osdoba had decided to cancel the agreement and continue the election. That mooted the issue and Rabbi Schwei did not re-sign.

Shortly thereafter, Rabbi Osdoba himself appeared at the polling station and cast a vote.
Shortly thereafter, Rabbi Osdoba issued a letter stating: “Whereas there was a misunderstanding with regard to the structure of the elections, a letter went out from me to postpone the elections. However, after further information I have decided that there is no prohibition at all on these elections and that they should continue with all vigor. Also, I agree that the elections should be extended through this coming Thursday, the 6th of Iyar.” {SEE EXHIBIT ???}

At no time during my meeting with Rabbi Osdoba that morning was the structure of the elections mentioned.

Upon information and belief, Shaya Boymelgreen was handed a copy of the agreement when he arrived at the polling station to vote. He proceeded from the polling station to Yeshiva Hadar Hatora where he conferred with Rabbis Osdoba, Segal, and Zirkind, as well as Mr. Rubashkin. He strongly urged Rabbi Osdoba to retract his signature on the agreement and to vote himself.

Upon information and belief, Mr. Boymelgreen is a major supporter of Rabbi Osdoba and is intimately involved in the affairs of the Beis Din and in particular, the Va’ad haKashrus—the kosher supervision arm of the Beis Din. He is known to despise Rabbi Schwei.

Upon information and belief, the previous Sabbath, Mr. Boymelgreen was heard shouting in his synagogue that Mr. Rubashkin should expel Rabbi Schwei from the Beis Din offices and change the locks so that he could not reenter.

Upon information and belief, Meir Eichler, Mr. Boymelgreen’s business partner, was present and also pressured Rabbi Osdoba to cancel the agreement.

At this time Rabbi Segal stopped answering my telephone calls. That afternoon, I proceeded to his house and confronted him regarding the morning’s events. Rabbi Segal indicated that I should approach Mr. Boymelgreen and Mr. Eichler instead of wasting time with the rabbis. When I asked, “Who makes the decisions around here, the Rabbis or the money-men?” he replied, “You see for yourself.” He also asserted that Rabbi Zirkind had approached Rabbi Schwei that morning, asking him to sign the paper signed by Rabbi Osdoba and that Rabbi Schwei had denied. I vigorously denied this, as Rabbi Schwei first heard this demand from me. He then modified the story saying that perhaps he had approached Rabbi Schwei’s people, rather than Rabbi Schwei himself. Upon information and belief, this too is false.

On Wednesday, May 3rd, I once again spoke to Rabbi Segal. He indicated that he intends to assume office based on these fraudulent elections and that he will then invite Rabbi Schwei to submit candidates for another election for additional members of the Beis Din. He indicated that he sees no reason why Rabbi Schwei would refuse such a “reasonable” offer.

I have no interest, financial or otherwise, at stake in this matter other than a desire to see corruption uprooted from my community and to see free, fair, and open elections to a Beis Din accepted by the entire community, rather than the charade that has taken place this week. I have received no compensation for anything I have done in this matter.

Several times over the past several weeks, Mr. Rubashkin has offered to pay me to urge others to vote.

During my Thursday night negotiating marathon with Mr. Rubashkin at the CHJCC office, I heard a reporter for a website call him. He gave the reporter several names of people to interview and then asked the reporter if he has audio/video equipment. When the reporter replied in the negative, he offered to pay for any such equipment and/or studio time out of CHJCC funds in return for the favorable interviews. I heard him say more than once that now “the gates are open” in terms of council funding. At the time, he told me he had already spent over $65,000 of council funds on pre-election publicity. His main advertising push took place after this—over the weekend—including brochures, glossy cards, cars circulating with loudspeakers, etc. etc. Later, he told me that he is paying the company certifying the election approximately $24,000. If his assertions are to be believed, he has already spent well over $100,000 of council money on these elections.

I submit the above information by affirmation, rather than affidavit, because as an Orthodox Jew, I am forbidden from swearing. I understand, however, that my affirmation has the same legal significance as an affidavit and that I am subject to the penalties of perjury in the same manner as if I had given an affidavit.

To All Anash:

The community has spoken forcefully and overwhelmingly, and rejected the Moshe Rubashkin/Yossi Brook cartel’s attempt to force their choice of Rabbonim on us. We reject their dictatorship! We will never accept their attempt to force Rabbonim upon the community against its will—contrary to the Rebbe’s instructions. We respect the candidates that stood for election, but we hope that they have the self-respect to face their rejection by the community, rather than attempt to force themselves upon us. Of over 2,300 eligible voters, by Sunday night less than 600 people voted (and 350 of them voted only in order to weaken the Beis Din – see below). That means that over 1,700 people stayed home and chose not to participate in this mockery of elections. The Netzigim, the real Netzigim, will now undertake the difficult task of finding suitable candidates and running a fair and honest election.

The Rebbe taught us that we must turn the negative into something positive. Indeed, the experience we have just gone through has taught us much:

• Both Rabbonim, on their own demonstrated that they are interested in making peace and they both signed an agreement to make fair elections. (It was only when pressured by individuals with self-interests and personal agendas that one of the Rabbonim changed his mind.)

• The organizers of the election showed their true colors. The election materials they distributed were transparently distorted and manipulative. They were full of personal attacks on some of the most prominent people in the community, and they brought down the level of public discourse to a new low.

• The election propaganda, and the election workers, were paid for with community funds. It is now high time that there is financial accountability by Mr. Rubashkin. Should he continue to ignore hazmonahs to Bais Din, then we will use legal pressure to have him comply with his responsibilities to the other members of the Vaad HaKohol and to the community at large.

An analysis of the election results, is as follows:

• 350 plus long-term enemies of the Beis Din, those who never participated in the elections even when the Rebbe was distributing dollars, came out to vote in force. They have always been interested in harming the institution of the Beis Din and they have refused to recognize or support it. Their interest here is to weaken the Beis Din by encouraging internal fighting.
To them we would point out that there has been enough fighting and machlokis in the community. By weakening the Beis Din they are weakening respect for all authority figures in our community – Rabbonim, teachers, parents, and ultimately creating disrespect, chas v’sholem, for Torah and Halacha. This is destroying all our families, including, G-d forbid, their own.

• 100 or so voted because they bought the argument that this is a war and they must defend “their side.”

To them we say that we are one community and we cannot allow ourselves to be split. If one side “prevails” over the other, we are all destroyed. The machlokis must be dealt with by mediation and resolving the dispute, not by layering additional splits and fighting on top of the existing problems. When the community clearly expresses its zero tolerance for continued fighting, the Rabbonim will be greatly encouraged to negotiate, just as they did this past motzei Shabbos, until certain people mixed in and interfered.

• A number of people who were intimidated/harassed/embarrassed into voting.
To this group, and the many others who have complained about all the irregularities in voting, we have requested a lawyer to look into the issues, to ensure that nothing like this happens again.

• The remaining individuals voted because they are so outraged at the present situation in the community and they desperately want a change.

To them we point out that no good can come from an edifice built on a faulty foundation. This election was designed to continue the machlokis, not resolve it, as many in the community do not recognize the validity of the results and do not accept the Rabbonim as part of the Beis Din.

As we said, the Netzigim will now begin the very difficult process of identifying proper candidates, with Hashem’s help, and arranging fair elections. In addition, we request the community’s help for the following projects:

First, we must remove those with personal, selfish agendas from positions of influence in the community. They have violated the community’s trust and placed all of us in harm’s way, may Hashem protect us. When the opportunity arises to remove them, please step up to the plate and do the right thing. Otherwise they will continue to destroy the Rebbe’s shchuna and mosdos.

Of utmost importance, we must encourage the Rabbonim to make peace. No one should side with one Rav over the other, as this simply encourages the dispute. The details of the arguments are not our affair, nor are the terms of resolution. We must all resist the temptation, and help our family, friends and associates resist the temptation, to take sides. Instead we must all ask and plead with the Rabbonim to negotiate to resolve their differences. It can be done if we work together. It must be done if we are to survive as a community.

"Election" Results are in! All 3 Candidates LOST the Election ! - More Than Two Thirds of C.H. REJECTED all 3 Candidates

The reported election results indicate that 2/3 of C.H. eligible Voters, listened to Harav Schwei and made sure NOT to vote.

This means that 3 Candidates LOST because they all got less than 1/3 of the vote from amongst all C.H. eligible voters!

The Machlokes is expected to reach an all time High, now, that they have completed their fiasco, of their corrupt "elections".

The Machlokes in Crown Heights, caused by Rubashkin and Company is now expected to go into High Gear and reach unprecedented levels, never seen before in CH, as the Majority of CH residents, are contesting any claims of any election results. Since Rubashkin refuses to come to a Din Torah, it will most likely have to be decided in Court.

Who is really “In Charge” ? Inside the Badatz: an EXPOSÉ

DaasHakohol, working with undercover investigators and detectives has uncovered an unprecedented wealth of information of incredible corruption and highly incriminating information on all those who are associated with, Clique of Boimelgreen, Brook, Katzman, Reitzes, with Rubashkin, Lang and Plotkin, and those who approved and Rubber Stamped their incredible Chutzpah and Machlokes against the Mara Deasra Harav Schwei Shelita.

Since Legal Action is currently pending against all of the corrupt individuals, we can’t disclose yet all the details of all of their crimes which we have uncovered but it will all be a matter of public record in the courts, as the papers are filed, in due time.

The following is merely the Tip of the Iceberg to give you a minor glimpse of one of the most “minor” corruption incidents which took place this past Sunday. Other similar incidents are 1,000 worse than this one. Nevertheless, from this story, you can begin to understand how deep this corruption runs and who is Really In Charge and Who is Really responsible for all the Machlokes in the Badatz.

EXPOSÉ:

This past Sunday, “Corrupt Election Day”, Rabbi Osdoba reached an equitable agreement which was very fair on both sides, which required to immediately Halt the Elections until a later date (6 weeks later) when Fair, Elections, can be held. Rabbi Schwei and Rabbi Osdoba, both signed these Peace Accords, in front of several witnesses.

A few hours later, Rabbi Osdoba gave a Shiur in Hadar Hatorah, where he was questions by his Class, if it was true that he canceled the elctions and why he canceled the Elections?

Witnesses, who were present at this Shiur, told our investigators, that Rabbi Osdoba appeared a little embarrassed, and sheepishly said that to begin with, this election was only thought to be, kind of “Like a Referendum or Like the Primaries” and so he agreed to Cancel It and delay it. But he definitely told his class that it is in fact true that the Elections Are Canceled.

However, as he walked out of his Hadar Hatorah Class, he was approached by an angry looking Boimelgreen who took Rabbi Osdoba into his Car where he “spoke” to him…..

Immediately afterwards Rabbi Osdoba Defaulted on His Written Contract Agreement, Defaulted the Peace Accords with his Fellow Rav and shocked everyone, by actually Voting Himself, in violation of his joint, previous, Lagal and Halachic, Contract Agreement, to cancel the Elections.

Whenever anyone signs an agreement between two people, everyone understands, that according to Halacha and according to the Law and according to normal human decency, One Person alone, can never cancel a Contract which was agreed and signed by Both, Parties involved!

Election Perspective - Rubashkin Refuses Peace

1. Eli Polterak works all night on shuttle diplomacy and gets both Rabbonim to sign to delay elections for 2 months and have an impartial committee supervise fair elections. The agreement is signed in the wee hours of Sunday morning - 3-4 A.M.

2. Moshe Rubashkin loses himself when he finds out about the peace agreement and physically attacks Yitzchok Holtzman, and later, Eli Polterak. He then convinces Rav Osdoba to cancel the peace agreement and go ahead with the elections. To assure his winning, he extends the election an extra four days to allow him the opportunity of pressuring, bribing and intimidating enough people to vote that the ridiculously low turnout will be less embarassing.

Moral of the Story: Just as we have been told for months, Rubashkin is against making peace in the Beis Din. Certainly if he added his support to the peace agreement, Rav Osdoba would'nt have nullified what he previously agreed to.

Rubashkin WANTS the community split - the better for him to be able to do whatever he wants without having to be accountable to anyone. As long as he is around the community will be consumed by machlokis!

C.H. Voters Convinced of Potential Election Fraud

As the day comes to an end with so few voters turning out to vote for Rubashkin's corrupt slate, new concerns over the week long election process is heard. Most voters feel absolutely certain that there will DEFINITELY be Election Fraud, especially since the election process will be dragged out over an entire week.

Normally, Each team who has a vested interest in an election outcome, will place their own observers to keep an eye on ballot counting. This process is all but impossible when the Voting process will continue for a week and possibly many weeks to come until the Corrupt leaders of this election are satisfied with the Voter Manipulation and when the outcome of the election is guaranteed in their favor.

Simply said. NO ONE can stay up for an entire week without sleeping to watch the Ballots. As everyone retires for each night Election Fraud is Virtually GUARANTEED!

Chronology of Events surrounding the ABSOLUTELY CORRUPT Election Proceedings

1) Motzoey Shabbos a Yungerman by the name of Poltrack, a well known community "Strait Shooter", successfully brokered a deal where both Rabbonim Agreed and signed a Deal to delay the election until such time and conditions where it will no longer be CORRUPT (As it is Now).

2) To everyones Amazement, Rubashkin refused to stop his Corrupt Elections, although BOTH Rabbonim had reached an agreement to NOT Make the Elections today.

Rubashkin went so far as to physically attack Mr Poltrack who brokered the successfully deal and Rubashkin also Physically Attacked Rabbi Yitchok Holtzman and others. Rubashkin also broke Poltracks Cell Phone.

All this action was recorded by secret surveillance Cameras.The NYPD and Rubashkin's Parole Officer are very interested in obtaining a copy of the Video Tape.

3) About noon time, Mr Lang walked into 770 and got up on the Bima and announced that Rabbi Osdoba "Changed His Mind"!!!!???!!! and defaulted on all his promises and said "the Election will go on as Scheduled".

Mr Lang used a supposed "excuse" that the Rabbi, only signed, because "he thought" that all candidates agreed, but since he later found out that not all candidates agreed, he defaulted on his agreement which he signed with his own signature in front of witnesses.

Everyone who had seen Rabbi Osdoba's Signature which specifically canceled the current Elections, refused to believe that Rabbi Osdoba would not keep his very own written promise and everyone was sure that Mr Lang must be mistaken or was lying.

4) However some time after 1 pm, when Rabbi Osdoba finished his Shiur etc. Rabbi Osdoba himself Absolutely SHOCKED everyone, when he was himself actually seen Voting, in direct a contradiction to his very own signed agreement of only few hours ago!!!!!!!!!

Shortly after the Rebbetzen Passed away, the Rebbe made 3 Wills.

1) Will # 1, was only regrading the Rebbe's personal estate, to be transfered to Aguch. This was required to be a legal will so that it will not be contested by the same people who contested 770, after Gimel Tamuz.

2) Will # 2 was not exactly what we would call a secular legal will, because it was to Chassidim who follow Torah and not the courts. This will is more properly and technically called a Tzavaah, and it deals with who is in charge of all the Rebbe's Mosdos, after Gimel Tamuz. This Tzavaah was in writing but reportedly not signed and was disputed. However our Rabbonim ruled that it was Halachically valid and should be followed.

3) Will # 3, more properly called a Tzavaah was regarding all Chassidim. It was regarding, whom to ask questions to, and whom to listen to, on matters of question. This the Rebbe gave us orally, via a Recorded Sicha of the Rebbe on the Night of 3 Adar 5748.

In this Sicha the Rebbe repeatedly says that we should ask and follow 3 Chassidishe Rabbonim however if you LISTEN to the Sicha, you will note that the Rebbe says that:

If you have 3 Rabbonim it's a Beis Din and if you only have 2 Rabbonim, then these 2 (together, should not make "Elections", but rather, instead these 2) Should Choose TOGETHER a 3d Rav.

The Rebbe explains that this is Al Pi Shulchan Aruch this way and is done so even regrading the Sanhedrin.

Indeed, this is exactly what was followed for the past FIFTEEN YEARS, since Rabbi Heller, quit the Beis Din, whenever, Rabbi Marlow and Rabbi Osdoba needed 3 Rabbonim, they CHOSE a Third, WITHOUT Elections, but they BOTH had to agree on who the 3d was TOGETHER!

NEWS FLASH! The Rebbe’s Room Minyan in 770 and Downstairs Minyan in 770 – Announced: "DO NOT TO VOTE" !

Friday Night, in 770:

Immediately after Gerlitzkie’s announcements, Yosul Motchkin, got up on the Bima, and announced that there is a Psak Din from one of the Rabbonim of the Badatz of the CH which forbids this Election and therefore no one may Vote.

Once More, Shabbos in the Day, right before Krias Hatorah, in Packed Shull, Yosul Mutchkin announced again that everyone should know that we have TWO Elected Rabbonim, and no one may Vote, until and unless BOTH Rabbonim agree to the candidates. Since Rabbi Schwei issued a Letter which forbids Rubashkin’s Corrupt Elections, therefore No One May Vote, Chas V’Sholom, in direct violation of Rav’s Psak Din which Assers this Corrupt Election Process.

DaasHakohol observed, neerliy everyone thanking Yosul Motchkin for having said, that which EVERYONE wanted to say, but only Yosul Had the Guts to actually get up and SAY it.

Support for Yosul Mothckin's announcement was so widely accepted by the entire Kehila, that not even one Protest Voice was heard, from anyone, in 770 – Everyone in 770 Agreed that Yosul Motchkin is 100% Right.

The Gabaaim of 770, seeing that the entire Kehila does not approve of this Corrupt Election, Anounced that they have decided to "not take any sides" and the section of the Shull usually used for such elections, will remain closed.

It was rumored, that Rabbi Osdoba, having the key (To the Ezras Noshim) from Mechiras Chometz, gave it to Rubashkin, although the Gabaim did not allow the use of the Shull for Election purposes.

Rubashkin and Company, reportedly used this key Illeagaly, to enter the premises and CHANGED THE LOCKS of the 770 Ezras Noshim, without permission from the Gabaim, to show the Gabaim that Rubashkin is Boss of 770 and NOT THE GABOIM! A Chutzpah Sh'Ein Komohu!

Some members of Anash have told DaasHakohol, that although they greatly Respect Rabbi Osdoba, however in the face of this Corrupt Election Process, they will make sure not to Vote, because they don’t want to get involved in this Unfair, Machlokes-Election which will only make matters worse.

To all our dear Anash of Shechuna's HaMelech, Kan Tziva Hashem Es HaBrocho:

As you all know the Rebbe was personally and publically involved in setting up a Beis Din and representatives for our community. So that there will be unity and guidance until we’ll once again see the Rebbe with our eyes of flesh.

Hashem created us all in His image. Yet ‘Ein Deioseihen Shovois’ as each one is unique with their own Maalos. Only, so that we could complement and help each other out.

As in any community there arise problems. But we need not see it as a negative about anyone cha”v. Just as technical problems to be solved. Sometimes, only by all of us being aware of a problem can we solve it be”h.

The Rebbe spoke about the Nitzchiyus of the Beis Din and it’s Rabonim. This means that once a Rav is elected he cannot cha”v be removed. Now this was meant specifically about those Rabbonim appointed to be part of the Beis Din of Mara D’asra (and not about any additional Rabbonim that at any time the Beis Din and community decide to hire to help out with Shaalos and Din Torahs. See the Rama at the very end of Hilchas Talmud Torah.)

When one of the Rabonim was Niftar and LeHibodel LeChayim Tovim another one doesn't want to be involved in decisions of Inyanim Kloliyim, so we were left with only one fully active 'elected' Rav. And with his Haskama another Rav was 'elected' who then 'receives' the same Koach of an 'elected' Rav and of Mara D'asra which the Rebbe spoke about and which the Rama (mentioned above) writes about.

Now we need another elected 'active' Rav for the Beis Din of 'Mara D'asra' to become fully active again, so that stale-mate decisions between the two existing active elected 'Mara D'asra' Rabonim could be decided by a majority.

But obviously any candidate worthy and acceptable (for community elections) to that position, needs first to be agreed upon and acceptable by both active 'elected' Rabonim of the community.

A true Beis Din is made up of three Rabonim who each has his own capacity for making decisions in Halocho and is not influenced nor Botul in his Halachik decisions to any of the other Rabonei HaBeis Din. So any candidate to fill the empty position has to be, besides a knowledgeable Rav and Yerei Shomayim, also not Botul in Halachik decisions to the opinions of any of the other two Rabonim.

Only then can there be a proper Beis Din of three Rabonim who are 'Mara D'asra' with independent opinions upon which any decision could be based on a basis of majority for the decisions of the Kehilo, which is decided only by those Rabonim who are, the, 'Mara D'asra.'

So, there needs to be a candidate which both active elected Rabonim 'agree' upon, that he is capable and worthy, and 'also' that he will make decisions for himself, and not based on satisfying one of them, in Inyonim of the Kehilo, etc.

All the candidates which are being put out for elections by the Vaad HaKohol now, do not meet all of these requirements.

Basically one of the elected Mara D'asra Rabonim feels that these candidates will not have their 'own' opinion in all matters of the community and will be influenced by one of them (the 'elected' Rabonim) and by others. And therefore it will not be a Kosher Beis Din of three Mara D'asra, but really merely the opinion of one Rav which will prevail over the opinion of the other Rav, which is not how a Beis Din is supposed to be.

There have been problems in various areas, as both Rabonim have different opinions, like in Kashrus and about representation of Netzigim and other decisions for the community. And as long as there are only two Mara D'asra, there needs to be the agreement of both, in all such matters. And, issues of Kashrus and some other issues have been the cause of a lot of strife and pain in our community.

This cannot go on and we need to find a candidate(/s), but only, to which both Rabonim 'fully' agree. Otherwise it will only cause even greater problems then we already have. And the Rebbe's Shechuna doesn't deserve this. Nor does any Jewish community deserve this cha"v.

So we beg of all of you who hold the Rebbe precious and this, his, community and it's welfare precious, please protest and do not let this present election happen. As it goes against and isn’t with the ‘agreement' of both Mara D'asra Sheyichyu.

Confused about the Elections?

In order for Elections to be Halachicly KOSHER and Valid, it must be organized by the Netzigim and not by a One Man Dictatorship (Mr. Rubashkin) and it must also be approved by each one of the preexisting Elected Rabbonim, as was the case in the Previous Elections for Rav.

Since these elections were established without any of the required Halachic Preconditions, therefore, Halacha says it is Null and Void, Illegal and Forbidden to participate in.

Who is Supposed to Approve the Candidates - According to the Rebbe?

From Sicho Shabbos Parsha Matos Mase 5746 (Tzadik Lamelech)2.

There are some individuals that decided, for some reason, that they are the owners of this schunoh and they are the ones that need to govern and control the entire community.For example:

When there is a need to elect a Rov to the schunoh – he, together with his friends are the ones that will establish and decide who is suitable to serve as Rov, and they will appoint him as Rov.It is unheard of such thing in Israel [Jewish Nation] – that an “askon” (activist) or few “askonim” (activists) will decide on their own on electing a Rov.

When they elected a Rov in Jewish Kehilos – Rabbonim, Torah Gedolim etc., decided who are the suitable candidates to serve as Rov, and not “askonim”, even “askonim” that have smichoh (Rabbinical ordination) to be a Rov, because it is known what the ñî"ò writes that the opinion of áòä"á (laymen) is the contrary of the opinion of Torah,

and like it was mentioned many times, that this, refers toáòä"á (laymen) that have smichoh to be a Rov because if it refers to people that do not have smichoh it will not be necessary to mention it, it will be self understood.

Even more so, when this “askon” announces openly - (after trying to speak quietly behind the scenes, and did not help) – that if his candidate for Rov will be elected, then he will give money etc., and if not he will not give …

and through this he wants to force on the entire community his opinions – there is no bigger shochad (bribe) then this!Such monies, given for the so called benefit of the community, with the condition that they should do as per the will of the one that gives the money – are not even from “klipas nogah” … (and definitely, they are not from Kedushoh), therefore, it is forbidden to use this monies for Kedusha matters!

No one will force his opinion on the community for a monetary bribe!

You don’t want to give money (only if they will accept your authority) – do not do any favors, your money is not needed, because, “By Me is the silver and by Me is the gold says Hashem”

…The wonder is – how he is not ashamed to say openly that if they will elect his Rov, then he will support the Rabbinical establishment, when everyone sees that this is a matter of “shochad” (bribe) in the most severe way!

Rubashkin's Response to Our Comments

After many readers commented on the letter issued by Moshe Rubashkin in the name of the Va’ad HaKohol, we received a response from the Va’ad addressing issues raised by individual's comments.

Presented in the extended article are the responses to the comments along with letters from Rubashkin in response to; Harav Mangel, L. Nash and C. Sprelin.

Replys to comments:

Can we have some information regarding each candidate: ie. schooling, background, accomplishments, etc., current residence?

Each of the candidates is well known, highly regarded and has extensive experience as a working Rov with the Crown Heights Beis Din. The Rebbe was emphatic that all dayanim must have "shimush" – practical experience, not merely lomdus. The Beis Din would be fortunate to have any or all three these outstanding candidates serving our kehillah.

Can we perhaps have also Rabbi Schwei's name on the ballot to reconfirm that he is indeed elected as our Rav?

Important questions have been raised pertaining to Rav Schwei’s legitimacy as a Rav for several reasons:

1. He ran unopposed in the last election;

2. He had been on the private payroll of a local businessman, and hence his objectivity might be questioned;

3. His election was predicated upon his accepting Rav Segal and Rav Raitport as colleagues – which he subsequently reneged upon;

4. His joining the Beis Din has resulted in a period of unprecedented divisiveness and public discord.

Nevertheless, in the interests of Sholom Bayis, the Vaad has decided not to alter the status quo in the hope that additional Rabbonim will help nurture an atmosphere of tranquility and clear majority opinion.

What's the difference? CH is not part of USA where information is disseminated. Obviously, we are still in "Communist Russia" where you get to vote yes or yes. Can't you people "SEE" what our "so called Chairman" is trying to accomplish?

Sadly the above correspondent is turning the facts on their head. The last election (which predated the current Vaad) was indeed a Soviet style election with no choices and only single candidate being offered on a take it or leave it basis.

The current election is open to any and all candidates. The Vaad has issued repeated calls for nominations, and remains ready – at this late date – to add additional nominees to the current list of candidates, regardless of who or where the nomination comes from. If the writer of this letter has any candidates to suggest, we are totally receptive.

There is no need for much information. Rabbi Segal was appointed to work in the beis Din by rabbi Osdoba and with the haskama of rabbi Schwei, Rabbi Raitport is a known talmid chochom and Posek very respected not only in Lubavitch but in Boro Park and beyond. Rabbi Yitzchok Zirkind is a very brilliant talmid chochom very sharp. he is compassionate and very understanding. He knows the job of a Rov. His whole life he has dealt in halacha.

Indeed all these are true facts.

All of the current candidates are tried and proven Rabbonim with genuine "shimush" per the Rebbe’s directives.

If we want a true SHALOM in the neighborhood, I think that ALL present Rabbonim be on the list as well. Then they will have to be all equal and there can be no more fighting and perhaps peace will prevail in our Shechunah and perhaps the young generation will have something to look forward to.

Once a Mara D’Asra is elected to serve as a Rav it is an appointment for life. Rav Osdoba has been a Rav with the Rebbe’s approval for two decades. As for Rav Schwei, there are strong arguments for having him run in a legitimate election, especially as he has chosen to reject the terms on which Rav Osdoba allowed him to become a candidate in the first place. However (see above) in there interests of sholom bayis we are not changing his status quo.

Why was it that in the last elections it was stated EXPLICITLY that only if the candidate Will garner more then 50% of ELIGIBLE voters (not "actual" voters) will he win? why isn't the same applicable now? (it was at the direct order of Rabbi Osdobo).

The last elections was not a bona fide election. At best it was a referendum since there was but a single candidate. Hence the need for approval by 50% of eligible voters. This Sunday’s election is a genuine election with three (or more) viable choices. Thus a simple majority of voters is sufficient. Anyone who chooses not to vote has no right to complain about the outcome.

Even more so, when this "askon" announces openly - (after trying to speak quietly behind the scenes, and did not help) – that if his candidate for Rov will be elected, then he will give money etc., and if not he will not give … and through this he wants to force on the entire community his opinions – there is no bigger shochad (bribe) then this!

We can only assume who wrote this disgraceful letter, and what his personal agenda might be. The fact is, this election is precisely the opposite – an honest, objectively monitored election that is open to ALL candidates.

This is in marked contrast to the last election in which alternative candidates were kept off the ballot. At that time private interests, by eliminating any competition, forced the community to accept a single candidate, one who was being paid for years by private balebatim. It is interesting that it is precisely the people who engineered the last election who are now accusing the current Vaad of doing what they themselves did and are trying to do again. Kol ha-posel mumav posel.

…sounds pretty democratic, either vote for them, or don't, in any case they win...how many are we electing? all 3? are we having 5 Rabonim? wow...

Untrue and unfair.

Voters have a right to choose one, two or all three candidates. Only a candidate who has garnered 50% of more of the popular vote will be named to the Beis Din. Thus it is entirely possible that the outcome will be only one additional Dayan, two additional Dayanim or even three. The complexion of the Beis Din will be radically different depending on how the community votes. And, once again, the roster is open to additional candidates. The write is welcome to make his own nominations.

Because when the people on top, compete, fight, hate, don’t get along, automatically all those under them tend to do the same.

Precisely. Which is why the election is so important. It is worth noting that there was no fighting or hatred in the Beis Din until the last election. Rav Osdoba was a Dayan for 15 years and there was never any public discord among the Dayanim.

True.

Which is why Rav Schwei needed Rav Osdoba’s approval to run for Rav in the last election. This approval was given conditionally, pending Rav Schwei’s acceptance of Rav Segal and Rav Raitport as colleagues.

At least with Rabbi Schwei's, election it had Rabbi Osdoba's, 100%, full approval, BEFORE the Election, for him to even be considered to be eligible to be a Candidate - Now, it has absolutely "NO ONES" Approval!

Once again, Rav Schwei received Rav Osdoba’s conditional approval, and these conditions were not honored subsequently. Hence it is moot whether Rav Schwei approves the candidates as they have already been approved by Rav Osdoba and have been rejected by Rav Schwei in abrogation of the terms of his original candidacy.

What a Chutzpah!, to step all over all 3 Elected Rabbonim of the Badatz - ignoring them and forcing an election against the will of Rabbi Heller and against the will of Rabbi Schwei and against the will of Rabbi Osdoba!

Rav Osdoba’s approval of the candidates and acceptance of them as colleagues is long-standing. Rav Heller chooses to abstain. Rav Schwei has, through his own actions, demonstrated that he does not accept the need for an existing Rav to approve candidates.

What's wrong with the Rabbonim we have now?

Two Rabonim are insufficient for a proper Beis Din. The Shulchan Aruch requires a minimum of three and ideally five, so that a proper majority opinion can be reached where there is no unanimity.

Shouldn't getting along with BOTH Rav Osdoba and Rav Schwei be important. One of the people running does NOT get along with Rav Schwei and has been brought to a din torah (and refused to show up!) Certain members of the election committee have also done that.

There is no precedent for a Rav to call his fellow Dayanim to a Din torah simply because he does not agree with them. And they are under no obligation to heed such a hazmana. While harmony among Dayanim is the ideal – and was the rule for 20 years prior to the last election – it is hoped that the current election will once again restore dignity and cooperation to the Beis Din as it was exemplified under Rav Osdoba, Rav Heller and Rav Marllow z"l.

The 3 candidates listed have all served as Dayanim in Dinei Torah on the BaDaTz together with one or more of the previously elected Rabbonim and have therefore been implicitly accepted as competent Rabbonim.

Absolutely, which is why the choices before the electorate are all outstanding and all 100% suited to the role of Dayan and Moro D’Asro.

The Crown Heights Anash would like to know weather the new elected Rabonim will have the same power as Rabbi Osdoba or will they be 'third class citizens'?

If the case is that they will not have the same power as R Osdoba then it's only fair that they be notified before hand to make sure that they still want to run even though they will remain '3rd class citizens'.

Every legitimately elected Rav becomes an equal with the other Rabbanim and is a Moro D’Asro in his own right.

Rabbi Schwei's election only brought machloikes and public mudslinging to the community unparalleled in any other Bais Din in the world. (Maybe R. Osdoba had the foresight to this tragedy that the rest of us did not). By the way how can he counsel couples on Shalom bayis if he washes all the community laundry in public? At least after this election the majority will rule and if the dissenting opinion chooses not to abide let him fight with the guy he sees in the mirror.

There are things we as the Vaad Hakohol are abstaining for stating. But, "chochom einav b’rosho."

They have my vote. R. Raitport is poshut a gaon olam, who is kol kulo torah & avodah. Rabbi Segal has the patience and the understanding of people to make a real difference in the community.

All this griping is coming from the old Netzigim gang that held the executive committee until 770's netzig was asked not participate and their junta fell apart.

The Vaad welcomes the idea of netzigim, and is hopeful that in future they will all be legitimately elected representatives of their mispalelim with no personal agendas other than to serve the community.

Letter to R. Mangel

Rabbi Mangel,

As the duly elected Vaad Hakohol of Crown Heights, and as individuals who greatly respect your enormous contributions in making the Rebbe’s Siddur accessible to the general public and your signal role in educating literally thousands of Jews in the ways of Torah, Yiddishkeit and Chassidus, we are pained and puzzled by your attaching your good name to recent partisan actions intended to de-legitimize Rav Shlomo Yehuda HaLevi Segal shlita’s role as a Dayan on the Crown Heights Beis Din, and by extension the Vaad Hakohol.

These partisan actions – by definition – do not represent the will of the majority of the Crown Heights Kehilla, or its best interests – and disrupt the long overdue attempt to restore functionality and integrity to the Crown Heights Beis Din.

We quote a letter from Rabbi Yaakov Schwei shlita dated 5 Iyar 5752 written on Beis Din stationery to this effect:

"What is in the interests of the community is up to a majority of the community to decide … and, according to the instructions of the Rebbe, even a Rav has no right to interfere, and as I was told by Rabbi Yitzchok Hendel, no one has the authority to interfere with someone who represents the community."

Furthermore, as you very well know, Rabbi Schwei’s position as a Rav on the Crown Heights Beis Din – assuming his election to the Beis Din was a priori legitimate – is contingent on the formal approval of Rabbi Avrohom Osdoba shlita. Rabbi Schwei’s candidacy was approved by Rabbi Osdoba on the condition that Rabbi Shlomo Yehuda HaLevi Segal serve as a Dayan on the Beis Din. Indeed, to the extent that Rabbi Schwei’s election had any validity at all, it was dependent on his accepting Rav Raitport & Rav Segal as colleagues on the Beis Din.

Hence, to label Rav Segal as a ‘minuy chodosh’ a new appointee, and demand that he step down from his work as a Dayan is deeply troubling. Furthermore, no Rav acting alone without the consent of his colleagues on the Beis Din has any right to summon a sitting Dayan to a Din Torah regarding that Dayan’s legitimacy.

For this reason, Rav Segal is not and cannot be in the category of ‘mesarev’ (refusing to answer a summons to a Din Torah) as he has no business responding to a frivolous summons that has no halachic basis. Indeed, Rav Segal is under orders from the senior member of the Beis Din, Rav Osdoba shlita who was elected under the Rebbe and has been Moro d’Asro in Crown Heights for some 20 years, to ignore any such summonses as they are without basis in Halacha and fly in the face of the very basis on which Rav Schwei is serving as a Rav.

I further call your attention to a response signed by Rav Marlow z"l, Rav Osdoba shlita and Rav Heller shlita dated 19 Av 5748:

"...There is (in Crown Heights) an absolute need (for an elected Vaad Hakohol) as has always been the practice throughout the Jewish world…
"Regarding its parameters … (citing numerous rabbinic sources); if there are more than seven elected members then they are responsible for all the needs of the community. If there are fewer than seven, they must clarify as to what they were appointed for, or declare that they are responsible for all the community’s needs.

"It is possible (for the Vaad Hakohol) to make an amendment establishing that a general meeting be called in the event that a predetermined number (that number to be established by the Vaad) of people request such a meeting … but until such time as there is a general meeting, the decision of the Vaad Hakahal must be accepted…"

What has come to light is that that there were indeed other candidates who were to be included on the ballot, but whose names were forcibly removed as a result of pressure from third parties who wanted to guarantee the outcome of that election – an outcome that could only result from a single candidate running unopposed, which was then – and continues to be – contrary to the wishes of a majority of Crown Heights ANASH.

The other candidate who withdrew under pressure from the list was Rabbi Yitzchok Raitport shlita.

At that time you, unfortunately broke your leg twice in two different places and you told people in the community that it was a sign ‘Min Hashamayim’ not to get involved in the Beis Din. Recently, the moment you signed the letter against the Mora d’Asro of over 20 yrs, you were laid up in bed with a Roiz on your foot and were incapacitated for many days.
With regards to yourself, what disturbs us especially is not only that you allowed yourself and your good name to be used to defame a Talmid Chacham whose role in the Beis Din is not open to dispute. What troubles us is that you would affix your signature to a letter which:

1. Refers to our Moro d’Asro with utter disrespect, referring to Rav Osdoba shlita as "he" and "him";

2. Refers to Rav Segal shlita as a "minui chodosh" when this is patently false;

3. Includes a third signatory who is from outside the community and is widely viewed as a troubled soul with no legitimacy whatsoever vis a vis anything to do with the Crown Heights Kehilla;

4. Legitimizes outright mesira by approving a civil legal action – something that is the ultimate prohibition, and guaranteed to result in a massive chilul Hashem and the utter undoing of the Rebbe’s community.
It is no secret that the Rebbe counseled you not to get involved in community Rabbonus. This is something you discussed openly. At the time, many of us were surprised by the Rebbe’s position in light of your signal contributions to Chabad-Lubavitch and your peerless record as a scholar, teacher and guide to thousands of talmidim.

Your recent actions have made clear why the Rebbe advised you to steer clear of community matters. We plead with you to follow the Rebbe’s advice and continue your heretofore unblemished record of doing what you do best.

Please note that this Vaad Hakohol, throughout its 14 month tenure, has scrupulously avoided any negative pronouncements, choosing instead to focus on positive activities, helping those in need, and shoring up the community’s infrastructure and services. It is unfortunate that a handful of individuals who are incapable of respecting the halachically mandated legitimacy of the Vaad Hakohol, are attempting to hijack the community and impose their will through secret pressure, terror tactics and outright deception. Under such circumstances we have no choice but to respond accordingly. We plead with you to distance yourself from these individuals and allow us to do our job – namely to restore the dignity and functionality of our Beis Din through legitimate and open elections. This is our job. It is why we were elected. It is what the Rebbe wants.

Response To Mr. Nash

To the Editor:

The letter by my fellow Vaad member Leibish Nash (Crown Heights Chronicle 4/7/06) is an offense to basic decency, to common sense, to the rules of law, and to Halacha especially the Halachos against motzi shem ra.

Above all it is an offense to the entire community of Crown Heights because he uses both innuendo and sheker to destroy the one democratically elected institution that, in its current incarnation, works tirelessly to improve the conditions and quality of life for the entire Jewish Community of Crown Heights without regard to politics or partisan issues.

The Vaad Hakohol, the Crown Heights Jewish Community Council, of which Mr. Nash is a board member, was democratically elected by the community to represent its best interests. It is my privilege to serve as its Chairman.

The record of my administration speaks for itself in terms of our ceaseless and successful efforts to address the needs of ANASH, especially those who because of widowhood, divorce or poverty lack the muscle and the loud voice to play the game of kol d’alim gvar,: victory to the most violent.

Indeed for the first time in its history, the Vaad Hakohol is being run as a democratic institution and therein lays its strength, its character and, above all its success. This Vaad is actually doing something. And we are doing it by simple majority vote, and we are doing it despite being saddled with some holdovers from the Vaad’s more Bolshevik past, when there was no democracy and, therefore no accountability to the one person we are accountable to: the man, woman and child on the street.

Yes, Mr. Nash is nostalgic for the good old days of smoke filled rooms and old boy politics. And when his voice is in the minority he resorts to outright lies and innuendo, such as "Two of the five rubber-stamped the deal after the fact" Of course, he mentions no names or dates, nor does he offer any evidence of any kind.

For the record, the Vaad meets almost daily. What's more, as secretary it was Mr. Nash’s job to record the minutes of the Vaad meetings. To date he has refused to provide any of his notes or minutes. Worse yet,our effort to hire a qualified secretary to record the minutes, Mrs. S, Yunick, were thwarted by none other than Mr. Nash himself.

Is it any wonder that Mrs. Fayge Hurwitz who was the best executive director quit because of Mr. Nash. Mr. Shaya Boymelgreen quit as a Vaad member because of Mr. Nash. Joseph B. Spielman has not spoken to Mr. Nash in 8 years, etc.

Mr. Leibish Nash and Mr. Yisroel Best met and employee of the Jewish Community Council and asked that she give them something to fight Moshe Rubashkin with. Then Mr. Nash and Mr. Best called the employee to apologize for having said something that never took place at a meeting, in order to defame Moshe Rubashkin. The Council’s employee wrote an affidavit and had it notarized detailing exactly what happened in this incident. This affidavit is on record.

Mr. Nash believes that merely by saying something it becomes true - especially if it appears in print.

Mr. Nash writes; "I was under the impression that if two Yidden have a disagreement, the Torah provides for a civilized and effective means of resolution." Except for the fact that we are not dealing here with a case of "two Yidden having a disagreement" that requires resolution. Rather, we are dealing with a board of five officials who were elected to govern the community and make decisions that effect the community by a universally accepted process called majority rule.

This is not a disagreement between "two Yidden".

When a disgruntled minority member of a governing body is unhappy with the result of a democratic vote, this does not entitle him to go crying to a makeshift trio of Rabbonim and demand a Din Torah.

Imagine what havoc this would do to a community if every majority decision were subsequently paralyzed because the loser didn’t get his way.

To blithely claim, as Mr. Nash does, that "Halacha takes precedence over democracy" reveals his ignorance of Halacha and his flouting of democracy. And when brandishing his ignorance, illiteracy and Bolshevik mentality to bully his way doesn’t work, Leibish Nash resorts to name-calling and referring to those he disagrees with as "inexperienced newcomers." Yes, we all know what the experienced veterans did when they held the keys to the Vaad – effectively nothing.

Russia had its experienced government which, thank G-d, was replaced by inexperienced newcomers. New York once had its experienced Tammany Hall hacks. Thank G-d they were replaced by inexperienced newcomers. And now, Boruch Hashem, Crown Heights is blessed with a solid majority of inexperienced newcomers on its Vaad Hakohol to help undo all the damage and self-serving backroom deals of the old boys who were swept out of office.

So, by al means, let Mr. Nash play the perennial crybaby running to his crony Rabbonim and jury-rigging ad hoc Zablo Beis Dins for relief. Let him calls us names and hurl adjectives such as "sham" and "gross" and "rubber stamp". Let him refer to genuine democracy and majority opinion as "manipulation". As we say, "kol ha-posel mumav posel." Mr. Nash can do his homework and look up what these words mean.

Finally there is some openness and clarity and blue sky in Crown Heights, and the people’s interests are finally being addressed. One cannot blame Leibish Nash for pining for the bad old days. But if he expects to bring them back he is going to have to do so by running his own slate for the next Vaad Hakohol and hoping it gains a majority.

Until such time he should act like a Mensch and play by the rules.

Response To Mr. Sprelin

To the Editor:

Our colleague Chanina Sperlin would have the reader believe that he has been kept out of the loop vis a vis the Vaad HaKohol’s scheduling elections for new Rabbonim. In fact this is not the case. Mr Sperlin has been involved in the process from the very beginning, and represents the minority view on the Vaad. It goes without saying that the Vaad has an obligation to issue materials that inform and educate the voters before they go to the polls. That Mr. Sperlin would prefer to keep the voters in the dark is understandable, coming from someone who wishes to torpedo the elections and maintain the terrible status quo.

He then goes on to assert that "If any of the Rabbonim (on the Beis Din) object to a candidate, that person shouldn’t be able to run since there is a psak din from the Chasam Sopher and the Tzitz Eliezer that no new Rov can be installed in a community without the approval of the existing Rov…"

Mr, Sperlin is 100% correct in this regard, and our existing Rov, Rav Osdoba shlita, has no objection to the candidates being fielded for election, including the candidacy of Rav Schwei shlita.The problem has been that Rav Schwei’s current position on the Beis din (for which he was allowed to run unopposed) was contingent on Rav Osdoba’s approval, per the very psak cited by Mr. Sperlin. However Rav Osdoba gave his approval only on the condition that Rav Schwei accept the presence of Rav Raitport shlita and Rav Segal shlita on the Beis Din. Unfortunately, Rav Schwei has chosen to flout this proviso, and has rejected and defamed both Rabbonim. Hence Rav Schwei’s position as Rov, based on the Chasam Sofer’s psak, is a priori null and void, and he must stand for election once again, this time in a bona fide vote against real candidates.
Mr. Sperlin then writes "I personally feel we should elect only one more Rov because the Rebbe said that a Beis Din means three Rabbonim."

Mr. Sperlin’s personal feelings are irrelevant. Further the Beis Din needs at least two more rabbonim as it now has only one legitimate Rov, namely Rav Osdoba. As for the Rebbe’s position – it has always been consistent with the Shulchan Aruch; Three Rabbonim are a minimum, not a maximum.

On a final note, Mr. Sperlin believes that Rabbonim should be nominated by "a panel of independent Rabbonim, or at least by businessmen that (sic) know something about Rabbonus." In this he truly flies in the face of the Rebbe’s teachings that our community Rabbonim should be picked by Anash. After all, "Asei lecha Rav" is not speaking just to businessmen. We are all in this together - and our Rabbonim must serve the needs of all people not just the interests of businessmen.

This Election is Rigged to be Against Rabbi Schwei

This is not Really, a True Election for a New Rav, but an Election Orchestrated by One Person, in order to effectively "throw out", Rabbi Schwei.

1) Rabbi Reitport doesn't live here, so we all know he can't be Rav of CH as the Rebbe didn't allow Rabbi Chanzin to leave his existing position of his home town to move to CH. (One Down 2 to go).

2) Rabbi Zirkind told many people he is not in the Running. Rubashkin is just using his name on the Ballot to Fool Us, into thinking that "You Have A Lot To Choose From".

Besides, if Zirkind won and had he agreed to Run (which he didn't), he would automatically, have to be aligned with Rabbi Osdoba, his personal Teacher (who is twice his age).

So this is not really an Election for a "New Rav" but an election to Give Rabbi Ozdoba the power to go against his existing adversary, against Rabbi Schwei.

3) Rabbi Segal? He is already in, over his head, in a Full Blast Machlokes against Rabbi Schwei!!!

Do we Chas V'Sholom, want to Elect such a, Big Time, Baal Machlokes, who is even Mesarev L'Din, himslef, Rachmana Litzlan?

He was called (Months Ago) to a Din Torah by 3 Rabboinim: Rabbi Schwei, Rabbi Bogomilsky and by Rabbi Mangel and Rabbi Segal refused to appear to the Din Torah! These 3 Rabbonim gave out a Psak Din against Rabbi Segal, Which Rabbi Segal refused to abide by!

How can a Rav who refuses Justice, when he is called to justice - How can such a Rav expect anyone else to respect him, if HE will ever be elected?

Do we want to elect a Rav, whom our Youth can "Look Up To", or do we want to Elect a "Rabbi", someone who disrespects the existing Beis Din, HIMSELF!

4) Rubashkin set up the Election in such a way that Rabbi Segal must win, because the voters have no choice to simply vote "NO", to all 3 choices (as they DID have the "NO" choice when voting for Rabbi Schwei).

This is a "Set Up" and a RIGGED Election because "someone" (one of these 3, Anti_Harav_Schwei "Rabbis",) has to win, even if the Majority of the Voters don't want them.

Rubashkin's FORCED "Election" is Specifically intended to be a Public LYNCHING of (at least) one of the Currently Elected Rabbonim !

By Rubashkin making Elections, AGAINST THE WILL, of the currently Elected Rabbonim, what Rubashkin is REALLY doing, is:

FORCING us to vote for New Rabbonim, whom the Current Rabbonim, Can't work with, which really equals "New and MORE Machlokes"!

Rubashkin's Election is REALLY, only about ONE THING:

In order to -> THROW OUT <- one or both of the 2, currently Elected Rabbonim!!!!!!!

In order for us to be able to sleep well at night, we tend to FOOL OURSELVES into thinking that "We Are (Kaviyochol,) Neutral" to the Machlokes, and so we turn a blind eye to Rubashkin's most Outrageous CHUTZPAH, against the Rabbonim and against the entire Kehila.

What happened to:

"LOY SAAMOD AL DAM REACHA" ? ? ? ? ?

Where is our Kovod Harabonim?

Should we all, "turn our heads", as though "we didn't notice", that Rubashkin's entire Election Campaign, is really, in order, to Drag us ALL into a MACHLOKES_ELECTION?

Rubashkin's so called "Election", REALLY is:

An "Election", to THROW OUT, one (or Both) of our Currently Elected Rabbonim ! ! ! ! !

A Vote, which will choose a Rav which is Specifically AGAINST the wishes of One Rav or Against the wishes of Both Rabbonim, is effectively a Vote to ELIMINATE and to THROW OUT one (or both) of our Currently Elected Rabbonim.

For anyone who can't figure it out yet, allow me to spell it out more clearly:

The Rubashkin's entire Purpose of his Forced Election is ONLY to have the Beis Din RIGGED so that Rabbi Schwei will be Sidelined by a New Rav, (Segal) who will be AGAINST him, and will give Rabbi Osdoba an "Automatic Majority (2 against one), against Rabbi Schwei!!!

We don't have enough Machlokes Yet in C.H. ? ? ? ? ?

All we need now, is an "ELECTION", to pour more Gasoline on the Fire, by Electing yet, another Rav, whom the current Rabbonim don't want?

We've all slept long enough, already.

Enough already, with treating a Tyrant, Mechutzaf with Silk Gloves!

It's time to "Take off the (Silk) Gloves and to "Tell it Like it Is!

Expose the Tyrant for whom he really is!

Just because he gives Almonos and Yesomim Chanuka Gelt and a fun ride in KiddyLand, or to the Museum, doesn't give him the right to Shecht the Rav Publicly (via "New Elections").

Anyone who remains "Passive" against Rubashkin's Outrageous Chutzpah, is not "Neutral" but rather, becomes a Partner-In-Crime!

All of us, who now choose to be "Neutral", or "Silent", are now becoming Partners, with Rubashkin's PUBLIC ("Election" which is actually a) LYNCHING, of one or both of the Current Rabbonim!

We will be forced to vote for at least 3 Rabbonim even if we don't like 2 of them. That's what I call gerrymandered!

Rubashkin Tries to Destroy the Netzigim

Rubashkin made a meeting in his house and called Netzigim. He then made a vote for a new Executive Board. "Elected" were Yankel Wice, Chairman, Benny Raskin, Vice-Chairman, Reuven Lipkind, Treasurer, and Moshe Haber, Secretary.

Objections:

1. He is no longer the Chairman of the Vaad and cannot call Netzigim meetings because he was removed from the Vaad by the Bais Din for not listening to three hazmonas.

2. There is an ikul in effect not to change the status quo until the Din Torah is heard. There are actually two injunctions, one signed by Rabbonim Gurary, Bogomilski and Mangel. The other signed by Rav Osdoba.

3. There was no quorum as several of the people who came were not valid netzigim.

4. Several of the netzigim who came were under orders from their shul not to participate, so they were there illegally.

5. Rubashkin's motivation is simply to avoid being impeached. He doesn't mind bringing down the community, as long as he is saved.
