The 2 Rabbonim, TOGETHER CHOOSE, the 3d Rav - No Elections - The Rebbe's Tzavaah - Listen to the Sicha!

Shortly after the Rebbetzen Passed away, the Rebbe made 3 Wills.

1) Will # 1, was only regrading the Rebbe's personal estate, to be transfered to Aguch. This was required to be a legal will so that it will not be contested by the same people who contested 770, after Gimel Tamuz.

2) Will # 2 was not exactly what we would call a secular legal will, because it was to Chassidim who follow Torah and not the courts. This will is more properly and technically called a Tzavaah, and it deals with who is in charge of all the Rebbe's Mosdos, after Gimel Tamuz. This Tzavaah was in writing but reportedly not signed and was disputed. However our Rabbonim ruled that it was Halachically valid and should be followed.

3) Will # 3, more properly called a Tzavaah was regarding all Chassidim. It was regarding, whom to ask questions to, and whom to listen to, on matters of question. This the Rebbe gave us orally, via a Recorded Sicha of the Rebbe on the Night of 3 Adar 5748.

In this Sicha the Rebbe repeatedly says that we should ask and follow 3 Chassidishe Rabbonim however if you LISTEN to the Sicha, you will note that the Rebbe says that:

If you have 3 Rabbonim it's a Beis Din and if you only have 2 Rabbonim, then these 2 (together, should not make "Elections", but rather, instead these 2) Should Choose TOGETHER a 3d Rav.


The Rebbe explains that this is Al Pi Shulchan Aruch this way and is done so even regrading the Sanhedrin.

Indeed, this is exactly what was followed for the past FIFTEEN YEARS, since Rabbi Heller, quit the Beis Din, whenever, Rabbi Marlow and Rabbi Osdoba needed 3 Rabbonim, they CHOSE a Third, WITHOUT Elections, but they BOTH had to agree on who the 3d was TOGETHER!

Listen to the the segment of this Sicha (It's less than One Minute) - Listen to it AGAIN and AGAIN, until there is no longer any confusion that this FORCED election is NOT the Road to Peace but rather the 2 Rabbonim must CHOOSE THEMSELVES a Third Rav, who they BOTH agree to TOGETHER! according to the Rebbe's Tzavaah given specifically for THIS Time!

You are distorting the Rebbe's words, and taking them TOTALY ou of context:
The Rebbe was reffering to an INDIVIDUAL question, if you have a question already, and in your city or town there are only 2 Rabbonim, those 2 should add a 3rd one.However,we are talking about a PERMANENT Rov, for THAT, you NEED elections.
The proof for this is: that after the Rebbe didn't allow Rabbi Chanzin to become Rov, the WAS ELECTIONS in C.H. for a 3rd Rov.

Menachem,

The position of this web site was never stated that the entire idea of having 3 Permanent Rabbonim is never a good idea for anyone, ever, in any situation.

It goes without saying that 3 Permanent Rabbonim, if they are available, is always an IDEAL that everyone would wish for and everyone would pray for and strive to achieve if possible.

Unfortunately, there are LOT more "Crooks" in the world than Honest People and there are a lot more UNQUALIFIED Rabbonim, than there are Honest, Qualified Rabbonim.

For example:
Why do you think Chanzin was on the ballot and won while others in CH lost the election? Because Chanzine was qualified while most others were not or if they were, they didn't WANT to Run.

When we Finlay put candidates on the ballot, do you remember how many we had? It was a handful ONLY, even in THOSE days, before all the "Fights", because there WERE (almost) NONE OTHER "Kosher", Qualified Candidates, but the "Other Team" (Fisherists and the LIKE's of them) who are throughly CORRUPT, to the core, certainly will never have a problem to find 10 candidates and even a 100 candidates because almost anyone can "foot the bill" of an "unqualified Corrupt Rabbi".

Is "everyone" rotten?

Of Course Not!

There are plenty of Kosher Jews, but not everyone who is Kosher and Honest and QUALIFIED, wants to run and perhaps some were told by the Rebbe not to run - but as for CROOKS, there are plenty and there will never, ever, be any shortage of "such" candidates.

Back to the POINT of the Sicha:

The only point of the Sicha is, that in face of our current situation where no Kosher Candidates are available, it is perfectly OK to use Temporaries and no one need be in any Hurry, that they can't even wait 6 weeks to seek out Kosher_Approved Candidates, according to BOTH Rabbonim.

To Illustrate it, even more clearly:

An Example:

Rabbi Mangel, is a perfectly fine Rav as a Temporary, and Rabbi Marlow used him for countless YEARS as "A 3d" Temp. Rav (since Rabbi Heller is Out of it, for some FIFTEEN years already).

Although Rabbbi Mangel is a perfectly Viable KOSHER Choice as a Temporary, yet he can't take this position as a Permanent candidate, either because he "doesn't want to" or perhaps it is true that the Rebbe told not to be a Permanent Rav.

Whatever the case is, no one argues that Rabbi Marlow was "as clean as a whistle" and everyone respected Rabbi Marlow and no one ever had a bad word to say about him and Rabbi Marlow used Rabbi Mangell (amongst others), OFTEN, and VERY OFTEN, as a Temporary 3d Rav IF and When needed.

Further More, Rabbi Osdoba did the same obviously, using Temps. - together with Rabbi Marlow.

If Rabbi Mangle was perfectly "KOSHER" by Rabbi Marlow's standards and by Rabbi Osdoba's standards for FIFTEEN years, and "no elections for 3d" was considered an "emergency" by anyone .......

If it was good for 15 years, the same "Temporary 3d" can work well for another 15 years and it isn't worth KILLING EACH OTHER to convert "a Temporary" into "a Permanent".

That's the ENTIRE Point of the Sicha!

Simply said Bekitzur: There is No FIRE! To Make a "JIHAD" for "Shecht's Im Mit a Bruche" (as they say it Satmar) to Shecht a Rav in Public because we prefer a "Permanent" instead of a "Temporary" 3d.....

It can "wait" OK, ...Beseder... and it's perfectly KOSHER this way too, according to the REBBE!....

No Fire.....No Emergency.....

No "Jihad" is worth it....not against either Rav...they can all live OK and get along with a "Temporary" a LOT better than with a Permanent one.

Why?

Simple!

Obviously both Rabbonim want someone they can feel "SAFE" with and not be "threatened" to not be "defeated" by an adversary.

This is a perfectly reasonable request by either Rav and is perfectly understandable that No Rav would want an adversarial Partner Rav.

Problem is that there can never be any guarantee as to who will remain a Friend and who Will eventually Betray You (As Segal did to R. Schwei).

This is the beauty of Rabbi Marlows way of doing it, to use ONLY a "Temporary 3d" because it is GUARANTEED to be non-threatening, to anyone, because if it ever "doesn't work out", then next Din Torah, you use a DIFFERENT 3d Rav but you're never "Stuck for Life".

When you're "Stuck For Life" then the only way is to continue to "Fight" (as is now the case). Temporaries is a Real GREAT solution which worked fine for 15 years already! Could be OK for another 15 years too.

When Rabbi Schwei was elected Rov the two Rabbonim agreed that in case of chilukei deyes they will take a specific Rov that lives in the schune to be the machria. But never happened!!! Wonder why!!!
