The Jewish Week - Crown Heights JCC Leader Sued

Board members say chairman owes council millions; Rubashkin claims row is over bet din.

A state court in Brooklyn is weighing whether to require the chairman of the Crown Heights Jewish Community Council to turn over financial records to his officers after two directors alleged that he has misdirected funds for personal gain.

But Rabbi Moshe Rubashkin emphatically denies the charges, insisting 'not a dollar, not 50 cents, not a penny' was misused. And at least one communal leader says the charges appear 'baseless.'

Judge Francois Rivera of state Supreme Court earlier this month called on Rabbi Rubashkin to show why an order should not be issued by the court requiring him to open the books. The motion also prevented the installation of three rabbis to a bet din whose election on April 30 is in dispute.

The two board members, Hanina Sperlin and Leibish Nash, want Rabbi Rubashkin to give up financial control of the council and pay at least $18 million to the organization.

A hearing in the case was scheduled for Monday but postponed until June 19 before Judge Michael Ambrosio, at which time the rabbi will have to explain why he should not have to show the records to the plaintiffs.

The case reveals a hefty power struggle within the tangled web of secular social service and religious organizations that controls life in the Crown Heights chasidic community, whose numbers are estimated at about 10,000. Thousands more adherents who look to Crown Heights for guidance are spread across the globe.

Rabbi Rubashkin’s election to the helm of the JCC, which disburses public and private money to those eligible for social programs while also funding neighborhood projects, drew some controversy in January 2005, because he had served 15 months in a federal prison two years earlier for writing bad checks to cover expenses for his failing textiles business.

He was nevertheless elected with more than 70 percent of 1,200 votes cast, more than the others on the slate. His supporters later said he would not be directly involved in the JCC’s finances.

But Sperlin and Nash allege that not only is he involved but “it appears that Rubashkin has used JCC funds for his own self-interest and personal expenses” while refusing to open the books to other trustees and bypassing other officers, according to court papers.

No details are provided in court papers about the alleged misdirection of funds. The plaintiffs are seeking “at least $18 million” to be repaid to the JCC, according to court papers, although the same papers elsewhere note that the organization’s assets are around $2 million.

“We are afraid his actions could affect the city’s funding to the JCC,” said the plaintiffs’ lawyer, Howard Rubin.

Rubin told The Jewish Week the suit was brought because Rabbi Rubashkin “unilaterally” scheduled an election to fill a vacancy on the communal bet din through a process that violated the JCC’s mandates, in the view of the plaintiffs.

“The clients came to us and said this is not according to bylaws and rules and successfully got a temporary restraining order preventing the certification of the election,” said Rubin. “In the course of an investigation we found out Rubashkin was using the letterhead of the JCC as if the election was approved by the JCC or the Vaad Hakohol.

”The Vaad Hakohol is the JCC’s religious arm, which carries out the elections of the bet din.

In an interview from Israel, where he was visiting his son this week, Rabbi Rubashkin spoke in great detail about the case, insisting the true aim of the plaintiffs was to prevent the installation of the rabbis to the bet din. He said he did not know why the plaintiffs opposed the rabbis.

“I don’t understand what they are trying to do,” he said. “They are coming at me from every which way. This isn’t about Moshe Rubashkin. What they really want in court is to stop the rabbanim [rabbis] from becoming rabbanim. That’s what they’re looking to stop.” He stressed that a vibrant communal bet din, which would interpret the teachings of the late Rebbe Menachem Schneerson, was imperative in a movement that dispatches thousands of emissaries throughout the world.

Of his past indiscretions, Rabbi Rubashkin said “I made a mistake in my life and paid a very heavy price for it, but paying the price doesn’t mean you are killed. Last year 450 people went to camp [thanks to the JCC], we gave out money like never before in the history of the JCC.” He added that he receives no compensation for his work with the council. He also insisted that the council’s books must be examined by government audits. “As long as you take any money from the government you must certify the books every year.

”The JCC is affiliated with the Metropolitan Council on Jewish Poverty, which administers some of its programs, such as Child Health Plus and job training and prepares the payroll of employees who work on those programs, although it does not directly fund the JCC.

Met Council’s director, William Rapfogel, said his inquiries into the matter suggest personality clashes were mostly to blame for the strife.

“We’re always concerned about any kind of allegations,” he said. “But based on initial discussions these seem to be baseless charges purely based on disagreements within the community. They have to do with a bigger machlokes [conflict], which has nothing to do with the provision of social services.

”Rabbi Rubashkin’s critics object to his spending thousands of dollars on an outside firm, Election Services Corporation, to certify the results of the election. The rabbi says the sum was about $15,000. He said the expense was justified to ensure that the results would not be questioned. But, in the court papers, the plaintiffs, who named Long Island-based Election Services Corporation a co-defendant in the suit, claim the election was not carried out in accordance with Vaad Hakohol guidelines, which require, among other things, that the tallying of results be videotaped. The lawsuit claims the company certified the election “notwithstanding the fact that it was informed that the election was not performed properly.

”Election Services Corporation, as of Tuesday, did not respond to a call and e-mail message seeking comment.

The lawsuit also claims that Rabbi Rubashkin held a meeting in his home last month to appoint new members of the JCC board — members who would support his stewardship — and that meeting violated the group’s bylaws. But the rabbi said his election was held to address violations of bylaws in the last election in September.

Marcia Eisenberg of the Jewish Legal Assistance Program, a division of the Jewish Community Relations Council that advises nonprofits, said she had been consulted on the dispute and had informed both sides that they had not conformed with JCC bylaws. She said the April meeting was likely held too far after the initial election to supersede it.

“If they did everything they say they did and adhered to the bylaws, the question is was it legitimate because it was done in April,” said Eisenberg.

Yankel Wice, a member of the JCC’s synagogue advisory council who supports Rabbi Rubashkin, said he “strongly doubts” the rabbi did anything improper.

“He has done things like provide clothing and housing for yeshiva boys and girls on Passover and helped with summer camp tuition and a lot of social programs, often using the monies that the council has,” said Wice. He insisted Rabbi Rubashkin had provided some accounting of the finances, if not to the level sought by his detractors. “What the plaintiffs in this case are seeking is every single record, every petty cash [receipt] and check stub. I am not aware of any organization that is required to provide that level of specificity.”

It seems to me that the Jewish week may also be on Moshes payroll , since they completely trivialize all Moshes serious crimes against the Community and paint them as if they were merely political differences.How many newspapers and websites does Moshe control? I just hope he doesnt take over Daashakohol.com because its the only free press left.

interesting article. it is stupid to say that they are on Moshe's payroll, actually such a statement is very childish.

But, if the accounts of the JCC only add up to 2m how can he be accused of stealing 18m?

Whichever way you look at it, Sperlin & Nash look very stupid from this article, and in general it did not generate any kiddush lubavitch.

A paper must report the obvious or else they would look stupid. Therefore, reporting the charges against Moshe, hardly qualifies them as being evenhanded. Besides, it is well known that they are in Krinskys pocket who today is a strong supporter of Moshe.

The Jewish Week also tried many times to interview Chanina and Liebish but they turned down the interview in order not to make a Chilul Hashem.

Why don't you go back and read the article, just one more time (for starters) and count how many times the article mentions the word "rabbi" when referring to Rubashkin, whom they know is a Convicted Felon?

(I counted SIXTEEN times, where it refers to Rubashin as Rabbi and "The rabbi")

Next:
Please read through the article one more time and count how many times they refer to Nash or to Sperlin, as "Rabbi"?

(I counted ZERO "rabbi's" for Nash and ZERO "rabbi's" for Sperlin)

Now you still don't notice see any bias?

Met Council’s director, William Rapfogel, seems so curiously "unbiased" here!

Charges of Rubashkin causing a loss of 18 million dollars is only a "personality clash" to the Met Council!

I guess for that matter the
Met Council could "innocently" say that the Arabs who Bomb and Kill Jews every day, really only have a minor "personality clash" between the Jews add L'Havdil the Arabs.

Dear Borough Park Blogger:

Chanina has many friends and is very well connected politically but Chanina is a man of true integrity.

Being a "Politician" and being "Corrupt" are not synonymous. Most Politicians including Chanina are very respectable and honest people.

Unfortunately the scandal of some, very few cases of certain prominent corrupt politicians, tends to blur the distinction between what is "Politics" and what is "Corruption".

As a Borough Park'er, I am sure you are aware of the recent corruption in your own neighborhood, in connection with the Borough Park JCC, which caused many prominent community leaders and associated Politicians to take the fall, for the misdeeds of a very small handful of corrupt individuals.

Anyone who is the least bit familiar with the Rubashkin Scandal in Crown Heights, knows that even without "the books" he has already been caught red handed, at so much corruption that his downfall is inevitable. It's only question of a few days, weeks or months at the most.

This isn't a Crown Heights issue any more. Because Met Council, foolishly decided to trivialize and ignore Rubashkin's inappropriate behavior (to say the least).

Met Council has now made themselves vulnerable to take the fall, themselves, for everything "the books" will ultimately prove in court, against Rubashkin, whom Met Council supports.

It's in Met Council's own best interest, not to trivialize such extremely serious allegations of gross corruption against the Chairman of the JCC under the umbrella of Met Council.

For the sake of the survival of all the rest of the JCC's, Met Council, should advise Rubashkin to resign immediately so that the matter can quietly be put to rest.

Likewise, everyone and anyone else who dares to pressure Channina and Leibish and others, to "take it out of court", are raising a Red Flag on themselves, "how guilty are they themselves?" to so desperately want to cover up on the corruption of one single, bad, rotten apple?

I think that Nash and Sperlin were very bright in properly evaluating the core, root of the problem and launching a "smart bomb" with surgical precision, at the precise target, without any unnecessary collateral damage.

To all who are concerned about the Chilul Hashem and Chilul Lubavitch etc.,

We are at the crossroads now, where we have a choice to either allow all this to continue and increase or we can in one split second, eliminate the entire machlokes in the community:

If Rubashkin Resigns Now, undoes all the damage he did and hands over the keys and the books etc, the entire case will be out of court in one split second.

The Chilul Hashem or the lack thereof, is totally in Rubashkin's hands.

My dear friends, please understand something very important regarding MACHLOKES.

I compare it to somebody getting sick. What do you do?

If it's something minor, you can just ignore it or wait for it to heal by itself;

If it's something major, you need a doctor - even major surgery, R"L.

Same with MACHLOKES, especially this one.

This is a very MAJOR Machlokes, which cannot be ignored or hope it will just fizzle away without outside intervention.

That's why we need a team of experts - a Bais Din, or, when that fails, what we have now - the courts.

In any case, an aggrieved party has a right to have an injustice, which was done to them, to be rectified.

To just ignore it will NOT prevent machlokes. In fact, it can lead to VIOLENCE, CHAS

In the Arab, lehavdil Israeli conflict, the Arabs say that in order to be peace, the FIRST thing has to be that Israel should give "back" everything, and then they will do us a Big Favor and stop killing the innocent.

However, everyone knows that the Arabs don't need an excuse of wanted "land" in order to kill Jews. They have done exactly the same thing before the Yom Kipur War and before 1967 and before israels Independence.

GOOD MORNING! (Thursday 6:00pm) to crownhightsinfo web site - They finally broke their silence - more than a WEEK after the case started!

The Lawsuit against Rubashkin is now more than a week old.

Their are rumors that Rubashkin Paid Off all CH websites to be silent on the issue in hopes most of CH wouldn't find out all the details.

How much money did Rubashkin pay crownhightsinfo and shmais for their deafening silence on the Rubashkin Law Suite which is more than a week old?

Now that it's printed in the Jewish Week and "the Cat is Out of the Bag", it was pointless to keep on holding back.

However Shmais is still maintaining their deafening silence!

Many Thanks to chinfo for finally waking up.

Perhaps someone can bring a cup of coffee to Shmais too.

State Representative and gubernatorial candidate Ed Fallon (D-Des Moines) held a press conference at the Capitol Thursday afternoon to discuss how Secretary of Agriculture Patty Judge’s campaign finance disclosure reports show the need for a Clean Elections Law in Iowa.

“Patty’s report, quite frankly, troubles me quite a bit,” Fallon said. “All across Iowa, family farmers and rural residents are deeply concerned about the growing power of corporate hog confinement operators. It’s disturbing to see such a large amount of money coming from these groups to one candidate.”

Judge’s 2005 campaign contributions included $10,000 from Alina and Peter DeCoster, another $10,000 from Leah and Sholom Rubashkin of AgriProcessors, as well as contributions from Syngenta, Monsanto and Dow Agro Sciences.

“I think Patty Judge would say these contributions are completely legal, and they are,” Fallon said. “The problem is the rules allow influence-peddling at a level that most Iowans are only beginning to become aware of. It’s perfectly legal, but is it ethical? I think not.”

Fallon said he will continue to alert the media to his findings in the reports of other candidates in the coming weeks.

“I would ask the public to be very vigilant about this, and to learn who is donating to the other candidates,” Fallon said. “The influence of big money in politics affects every other issue, and is really the critical issue in this campaign.”

You are correct but the differences go a lot further.

Moshe is not just a convicted felon, he also served hard time because of his long history of criminality. Moshe is also currently on parole , so its not just a matter of a convicted felon, he is actually a person who is still part of the criminal justice system as we speak. Therefore its not just his past, its his present status thats a problem too.

Herzog committed only a minor offense that took place over 15 years ago and the judge acknowledged that it was just bad judgment and let him off the hook. Therefore , there can be no comparison between the 2.

Moshe has a criminal history going back 30 years that is still not over with. Besides all of those clear differences, there is another very big difference:

Herzog was not the Chairman and did not get involved with programs even though he would be allowed to , since it was over 10 years from his minor infraction.However, Moshe chose to appoint himself as the Chairman of the CHJCC, thus becoming very high profile and taking responsibility over all the programs and putting them all at risk and exposing crown heights to very bad press.

The Chilul Hashem that Hertzog has caused is unparalleled.

Rubashkin was in Jail in Fort Dix!

No other Vaad Hakohol member, except Rubashkin, was ever in Jail, even if they did get an occasional Parking Ticket.

Rubashkin is trying to make it sound as though it was only a "bounced check".

No one goes to jail for bouncing a $5 check.

Rubashkin was convicted of deliberately writing hundreds of thousands of dollars of checks on an empty account. That's not called a "bounced check". That's called deliberate premeditated fraud. That's why he went to Jail.

But Rubashkin can't tell the difference between day and night and apparently didn't learn his lesson from his served Jail time.

To Rubashkin, his felony fraud, is "the same" as someone getting a summons for driving without seat belt!

Those people attacking Chanina Sperlin and Leibish Nash are totally missing the point.

Do you think that they wanted this fought in a secular court? Of course not!

But after every option is exhausted and Moshe is running around like a cowboy and the corruption is running unchecked then there is no alternative. Every method was tried to get Moshe to come to a Din Tora.

Moshe was advised to refuse to appear at a din tora, thus creating a situation of anarchy in Crown Heights. Under those circumstances and a heter from Rabonim , ( because Moshe has a din of a mesarev) it is not only permitted to go to court, but in a Community situation it becomes an obligation to take it to court to save the entire Community.

I know this comment would not be accepted on crownheights.info, since their webmaster seems to only allow pro Moshe comments, even if they are full of hatred and the most derogatory in nature totally unbecoming of a Chosid.

1) Rubashkin leaked it to the Jewish Week so they will make him "look good". This is self evident to everyone who reads the Jewish Week article and sees that they gave him a relatively favorable review.

It's also evident from the reporter of the article who says he spoke to Rubashikin (for hours,) in great detail, while Nash and Sperlin refused the interview with the Jewish Week ! ! !

2) This entire Machloke can be over in ONE SECOND FLAT !

I think it's time for Moshe to throw in the towl, otherwise it's going to get to a point, where he will not have a chance to resign.

Moshe! keep up your good chesed to the Crown Heights as before, and quit the jcc NOW.

If someone can print up T-shirts and bumper sticker, which says " Moshe, Please resign NOW, for your sake and the community."

Nash deserves the total support and encouragement of the community for the extremely difficult position he is taking. Unfortunately, there are few in the community who genuinely care about the Council. Everyone has his own agenda. Nash, however, is doing this because he is obligated by LAW to do so. Anything that has violated law can bring him into the arena of culpability.

The Council's reputation and future is sinking fast. It is the one institution which must be beyond reproach so it can succeed in keeping programs running and bringing in new ones to grow. The community stands to lose everything it has built up all these years. Anyone who has every received any service or help should care about what is currently happening. Don't minimize the Council's history and results, and what this can mean for its future.

What is holding back the support for Nash is that Moshe Rubashkin will be hurt. But, who is commiting a type of political and community suicide here if not for Moshe Rubashkin himself. If you can't take the heat you should get out of the kitchen. But Moshe Rubashkin will not do the right thing and resign. He must win in his mind at all costs. He is a sort of tragic figure who has succeeded as a true dictator to control every major facet of the community: the Council is his plaything, his private business. He is the Chairman and at the same time the executive director. He controls the entire board and has nullified any independent action Lang or Plotkin might shakeningly try to muster up. Nash and Sperlin have been nonexistent up to now. And, even the Beis Din appears to be tightly under his grip. He has made a mockery of the community structures. Furthermore, last but not least, is the way he turned the Nitzigim on its head.

The truth be told is that he is incapable of proper and effective management. If he wants to give tzdakah, let him do it as a private individual so he doesn't destroy the lives of others by his reckless and irresponsible actions. Moshe Rubashkin can never properly serve on the board of directors because everything must be done his way. He does not know what it means to be a team player.

Rules in his book will be followed only if they don't get in his way.

If you care about Moshe Rubashkin help him to understand that he should do the right thing and resign. That action by itself will finally allow him to EARN some status instead of demanding it from everyone.
